§ 3.55.010 DEFINITION.

For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.

SELLER OF FIREARMS. Any person who sells or offers for sale at retail any firearms.

§ 3.55.015 PERMIT REQUIRED.

(A) No person shall engage in, conduct, manage or carry on the business of seller of firearms without a written permit from the Chief of Police. Initial application shall be accompanied by the payment of an investigation fee of $250 for each permit applied for pursuant to the provisions of this chapter, and a fee of $50 for each renewal thereof to the City Treasurer and the filing of proof of such payment to the Chief of Police. The permit shall be nontransferable and shall be valid for one year.

(B) If a permit is denied, suspended or revoked, the permittee shall have the rights of notice, hearing and appeal. Any person, who is exempt from the licensing requirements under the provisions of Cal. Penal Code §§ 26505 et seq., may apply for and receive a permit under this chapter for an initial application fee of $50 and for an annual renewal fee of $25.

§ 3.55.020 FIXED LOCATION.

Each permittee must have a fixed place of business. Sales of firearms may only be made from that fixed place of business.

§ 3.55.025 OVERLAPPING BUSINESS.

If any person shall engage in, conduct, manage or carry on, at the same time, more than one business requiring police permits, such person shall comply with all of the provisions affecting each business.

§ 3.55.030 PERMITTEE RESPONSIBILITY.

It is the duty of the permittee to see that no firearms are sold or offered for sale in violation of the law.

§ 3.55.035 PENALTY.

Any violation of this chapter is a misdemeanor.
