4-4.301 - Special speed zones.

Whenever, as authorized by the Vehicle Code of the State, the Council determines, upon the basis of an engineering and traffic survey, (1) that a speed equal to or greater than twenty-five (25) miles per hour would facilitate the orderly movement of traffic and be reasonable and safe upon any street, other than a State highway, otherwise subject to the Vehicle Code of the State prima facie limit of twenty-five (25) miles per hour, or (2) that the prima facie speed limit under State law is more than is reasonable and safe upon any street, the Council may determine and declare by resolution a special speed zone on such street, or a designated part of such street, in which zone the Council finds a different prima facie speed limit authorized to be established by the Vehicle Code of the State is more appropriate. Any such declared prima facie limit shall be effective when appropriate signs giving notice thereof are erected upon the street and shall nor thereafter be revised, except upon the basis of an engineering and traffic survey.

4-4.302 - Speed signs for special speed zones.

When the Council has declared by resolution a prima facie speed limit on any street other than the limit specified under the Vehicle Code of the State for such street, the City Superintendent or other City official having charge of public works shall cause to be erected and maintained on such street appropriate signs giving notice of such declared prima facie limit. All such signs shall conform to the requirements of the Vehicle Code of the State as to placement and design.

4-4.303 - List of speed zones established.

(a) There is hereby established an "Official List of Special Speed Zones" to be maintained in the office of the City Clerk. The City Clerk shall cause all special speed zones declared by Council resolution pursuant to this article to be recorded on such list, including the special speed limit, the street or part thereof included in such speed zone, and the number and date of adoption of the resolution declaring it. Whenever any special speed zone is revised or deleted by Council resolution, the City Clerk shall cause such revision or deletion to be recorded on such list.

(b) Such list and the record of adoptions, revisions, and deletions of special speed zones recorded thereon as provided in this section shall be prima facie evidence of the existence and legality of the special speed zones on the designated streets, or parts thereof, and of the legality of the placing of the appropriate signs provided for in this article. Such list as established and amended shall be deemed incorporated into and made a part of this article.
