Sec. 2.24.010. - Office.¶
The office of town clerk, as established by Government Code § 40801 et seq., is specified in this chapter.

Sec. 2.24.020. - Appointment.¶
(a) The town clerk shall be appointed by majority vote of a quorum of the town council at a duly called regular or special meeting thereof.
(b) The town clerk shall serve at the pleasure of the town council; provided, however, that nothing herein shall prohibit the town council from approving a contract between the town and any person (and such person's employer, if applicable) for a term of months or years which contract obligates the town to compensate the person for all or part of the term of the contract regardless of whether the town council exercises its right to relieve the person of his or her duties as town clerk.
(c) The offices of town clerk or deputy town clerk may be held by a member of the town council on the condition that no financial compensation is given to such appointee.

Sec. 2.24.030. - Contractors.¶
The town clerk may be either a town employee or an independent contractor. If the town clerk is an independent contractor, he or she may perform duties as such with the assistance of his or her own employees and, if allowed by the town clerk's contract with the town, through his or her subcontractors.

Sec. 2.24.040. - Duties.¶
(a) The town clerk shall have those duties, and exercise those powers, as may from time to time be specified by state law or otherwise according to law or any contract between the town and the person appointed to the office, or otherwise by resolution of the town council.
(b) The town administrator or town manager may assign duties to the town clerk, consistent with the contract between the town and the town clerk and with applicable laws, ordinances, and regulations.
(c) The town council may relieve the town clerk of duties assigned to him or her by statute by assigning the same to any deputy town clerk that the town council may designate.

Sec. 2.24.050. - Deputies.¶
The town clerk may appoint one or more deputies if authorized to do so by state law, but the town shall be obligated to compensate such persons only if the town council approves a contract that requires it to do so.

Sec. 2.24.060. - Authority of town administrator or manager to act as deputy clerk.¶
The town administrator or town manager shall be appointed by the town clerk as a deputy town clerk, who shall thereupon be authorized to act as such on behalf of the town clerk in the absence of the latter or when it is convenient to do so.

Sec. 2.24.070. - Facilities and equipment.¶
(a) If the town clerk is a town employee, the town shall provide all necessary office space, facilities, equipment, and supplies, at town expense.
(b) If the town clerk is not a town employee, the town clerk's office space, facilities, equipment, and supplies shall be provided as specified in the contract between the town and the person appointed to the office.

Sec. 2.24.080. - Compensation and benefits.¶
The town clerk shall receive such compensation and benefits, if any, as may be established from time to time by the town council, subject, however, to any contractual requirements.

Sec. 2.24.090. - Bond.¶
If required by state law or this Code, the town clerk shall be bonded in such amount as the town council may from time to time prescribe, at the town's cost and expense. If, at any time a bond is required, the town clerk becomes unable or ineligible to be bonded, he or she shall thereupon be disqualified from the office.
