Sec. 2.08.010. - Office.

The office of town treasurer, as currently specified by Government Code §§ 41001—41007, is established. The town treasurer may also be referred to as the town finance officer.

Sec. 2.08.020. - Appointment.

(a) The town treasurer shall be appointed by majority vote of a quorum of the town council at a duly called regular or special meeting thereof.

(b) The town treasurer shall serve at the pleasure of the town council; provided, however, that nothing herein shall prohibit the town council from approving a contract between the town and any person (and such person's employer, if applicable) for a term of months or years which contract obligates the town to compensate the person for all or part of the term of the contract regardless of whether the town council exercises its right to relieve the person of his or her duties as town treasurer.

(c) The offices of town treasurer or deputy town treasurer may be held by a member of the town council on the condition that no financial compensation is given to such appointee.

Sec. 2.08.030. - Contractors.

The town treasurer may be either a town employee or an independent contractor. If the town treasurer is an independent contractor, he or she may perform duties as such with the assistance of his or her own employees and, if allowed by the town treasurer's contract with the town, through his or her subcontractors.

Sec. 2.08.040. - Duties.

(a) The town treasurer shall have those duties, and exercise those powers, as may from time to time be specified by state law, or otherwise according to law or any contract between the town and the person appointed to the office, or otherwise by resolution of the town council.

(b) The town administrator or town manager may assign duties to the town treasurer, consistent with the contract between the town and the town treasurer and applicable laws, ordinances, and regulations.

(c) The town council may relieve the town treasurer of duties assigned to him or her by statute by assigning the same to any deputy town treasurer that the town council may designate.

Sec. 2.08.050. - Deputies.

The town treasurer may appoint one or more deputies if authorized to do so by Government Code § 41006 or a successor statute, but the town shall be obligated to compensate such persons only if the town council approves a contract that requires it to do so.

Sec. 2.08.060. - Town administrator.

(a) The town administrator or town manager shall be appointed by the town treasurer as a deputy town treasurer, who shall thereupon be authorized to act as such on behalf of the town treasurer in the absence of the latter or when it is convenient to do so.

(b) The town council may appoint the town clerk or any deputy town clerk, the town administrator, or the town manager as the town treasurer.

Sec. 2.08.070. - Facilities and equipment.

(a) If the town treasurer is a town employee, the town shall provide all necessary office space, facilities, equipment, and supplies, at town expense.

(b) If the town treasurer is not a town employee, the town treasurer's office space, facilities, equipment, and supplies shall be provided as specified in the contract between the town and the person appointed to the office.

Sec. 2.08.080. - Compensation and benefits.

The town treasurer shall receive such compensation and benefits, if any, as may be established from time to time by the town council, subject, however, to any contractual requirements.

Sec. 2.08.090. - Bond.

The town treasurer shall be bonded in such amount as the town council may from time to time prescribe, at the town's cost and expense. If, at any time, the town treasurer becomes unable or ineligible to be bonded, he or she shall thereupon be disqualified from the office.
