10.68.010 - Regulation of parades.

It is unlawful for any person, firm, association or corporation to conduct, aid, or participate in any parade, march, assembly, ceremony, exhibition, pageant or procession of any kind of any other similar display, or cause the same upon any public street, alley, park or any other public grounds in the city unless there has first been obtained from the chief of police a permit to do so, and said permit shall be carried by a person heading or leading such parade or event.

10.68.020 - Permit—Application.

A. Any person desiring to conduct any parade or event enumerated in section 10.68.010 shall, not less than two working days before the date on which it is proposed to conduct such an event, file with the chief of police a written application setting forth the following information:

  1. The name of the person or organization wishing to conduct such parade or event;

  2. If the parade or event is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization;

  3. The name, address and telephone number of the person who will be the chairman of the event and who will be responsible for its conduct;

  4. The name, address and telephone number of the person or organization to whom the permit is to be issued;

  5. The date when such event is to be conducted;

  6. The place where the event is to be held, the route to be traveled, if a parade is involved, and the starting and termination points of such parade;

  7. If a parade, the approximate number of persons who, and animals and vehicles, which will constitute such parade; the type of animals, and a description of the vehicles;

  8. If a parade, whether it will occupy all or only one-half of the width of the streets proposed to be traveled;

  9. The hour when the event will start and terminate;

  10. The location of streets of any assembly or assembly area for any parade;

  11. The time at which such parade units will begin to assemble at assembly areas;

  12. The intervals of space that will be maintained between units of any parade;

  13. Indemnification, defense, and hold harmless agreement;

  14. Insurance documentation in accordance with section 10.68.030.

B. If any event is designed to be held by and on behalf of or for any organization other than the applicant, the applicant for such permit shall file with the chief of police a communication in writing from such organization authorizing the applicant to apply for such permit on its behalf.

10.68.030 - Permit—Issuance.

If, from consideration of such application and such other information as the chief of police may otherwise obtain, the chief of police finds that:

A. The conduct of such event will not substantially interrupt the safe and orderly movement of traffic contiguous to the area or streets where the proposed event is to be held;

B. The conduct of such event will not require the diversion of so great a number of police officers of the city to properly police the streets and areas being used, as to prevent normal police protection to the city;

C. The concentration of persons, animals and vehicles will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous thereto;

D. That the applicant has provided for the services of a sufficient number of monitors to control the orderly conduct of such event;

E. The conduct of such event is not reasonably likely to cause injury to persons or property;

F. If a parade, that it will move from its point of origin to its point of termination expeditiously and without stopping en route;

G. Such event will not result in conflict, violence or other disturbance of public peace; and

H. Such event is not to be held for the sole purpose of advertising any product, goods, wares, merchandise, or event, and is not designed to be held purely for private profit; the chief of police shall issue a permit therefor.

I. That the applicant has filed with the city clerk a policy, true copy thereof, of a certificate of insurance as evidence that the applicant has in effect commercial general liability insurance at least as board as Insurance Services Office form CG 00 01 for bodily injury and property damage in the amount of one million dollars per occurrence, two million dollars aggregate on a per project or per location basis. If a per project/location endorsement is not available, the limit for the general aggregate should be doubled. The policy shall provide and be endorsed to include, the city, its officers, officials, employees, agents, and volunteers as additional insureds on ISO form CG 20 10 (or equivalent). The policy shall be primary and not seek contribution from the city's coverage, and the coverage shall include a waiver of subrogation in favor of the city. The city reserves the right to modify such insurance requirements based on the nature of the risk.

J. Failure of the applicant to file such certificate of insurance and additional insured endorsement, policy or such copy thereof shall be grounds for denying any permit provided for in this chapter.

10.68.040 - Permit—Rejection—Notice.

The chief of police or his designated representative shall, within four hours after the filing of such application, act thereupon the application. If the chief of police or his representative finds that such permit should not be issued, they shall mail, within one day after the date upon which such application was filed, a notice of action, stating in general terms the reason for denial of such permit. Such notice shall be mailed to the applicant at their address as given upon the application and the applicant, if at all possible, shall be contacted by telephone of such rejection.

10.68.050 - Permit—Denial—Appeal.

A. Appeal of Permit Denial. An appeal may be taken to the city manager at any time five days after denial by the chief of police and the city manager or his representative shall act on the appeal within four hours of receipt of the appeal. If the city manager rejects the appeal, notice shall be provided as specified in Section 10.68.040 of this chapter.

B. If the applicant is aggrieved by action taken by the denial of such permit by the city manager, they may appeal to the city council by filing with the city clerk a statement addressed to the city council stating forth the facts regarding the action taken in such denial. The city clerk will notify the applicant in writing of the time and place set for the hearing of their appeal. The city council at its next regular meeting that the posting requirements as provided for under the Brown Act can be met, shall hear the appellant and all relevant evidence and shall determine the merits of the appeal. The city council may affirm, override, or modify the denial and its actions thereon shall be final.

10.68.060 - Alternative permit.

A. The chief of police, in denying such application, may authorize the conduct of such event on a date, at a time, or at a location or by a route different from that named by the applicant, and if the applicant desires to accept the proposed date, time, location or route, he shall within two days after notice of the action of the chief of police, file a notice of acceptance with the chief of police.

B. The chief of police shall thereupon issue a permit.

C. Such permit shall conform to the requirements of Section 10.68.030.

10.68.070 - Interference with parade.

No person shall, without the consent of the permittee, join or participate in a parade, nor in any manner interfere with its progress or orderly conduct.

10.68.080 - Parade peddler permit.

The city may, upon due application, issue to properly qualified persons, a permit to peddle at parades.

10.68.090 - Peddler applicants.

Applicants must be nonprofit associations or corporations organized primarily for veterans, patriotic, welfare, religious purposes, to promote the community or a Farmersville business. Each such organization must have its principal and permanent meeting place within the boundaries of the Farmersville Elementary School District.

A. Applicants for permits will be accepted by the city clerk. It shall be the duty of the police chief to approve or deny such applications.

B. Applications shall be filed with the city twenty- four hours prior to date of issuance of a permit.

C. The permit will only be good for day of issuance.

D. Permits will carry fees established in the city's comprehensive fee schedule.

E. Each peddler shall carry a copy of the permit issued at all times.
