§ 14.40.125. Parking Time Limited in Business Districts.

When authorized signs are in place giving notice thereof no person shall stop, stand, or park any vehicle within a business district between hours of 7:00 a.m. and 6:00 p.m. of any day except Sundays and holidays, for a period of time longer than two hours.

§ 14.40.130. Time-Limited Parking.

A. The City Traffic Engineer is authorized to install signs and curb markings, as necessary, to designate time-limited parking zones in the City between 20 minutes and four hours.

The process to designate time-limited parking zones, shall be based on City of Encinitas Time-Limited Parking Policy (Policy No. C038).

B. The City Traffic Engineer is authorized to determine exceptions and restrictions to the designated time-limited parking area to certain days of the week, hours of the day, and holidays as deemed necessary and applicable to the location giving notice of such regulations.

C. The provisions of this section shall apply to any time-limited parking areas in which signs and curb markings designating the durations are implemented. No operator of any vehicle shall stop, stand or park such vehicle for a period of time longer than the duration defined by the implemented signage and marking.

D. The City Council, at its discretion, may direct the City Traffic Engineer to designate time-limited parking zones and implement time-limited parking on any roadway of the City.

§ 14.40.140. Parking Space Markings.

The City Traffic Engineer is authorized to install and maintain parking space markings to indicate parking spaces adjacent to curbs where authorized parking is permitted.

When such parking space markings are placed in the highway, subject to other and more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space unless the size or shape of such vehicle makes compliance impossible.

§ 14.40.145. Parking of Recreational Vehicles.

A. No person shall park a recreational vehicle on any public street or public property between the hours of 10:00 p.m. and 6:00 a.m. without the vehicle displaying a validly issued permit pursuant to Section 14.40.150 of this Code. "Recreational vehicle" means any trailer, camper trailer, boat and trailer, cab-over camper/truck camper, motor home, or similar vehicle. Also, vans or van conversion being used for habitation purposes or camping purposes shall be subject to provisions of this chapter.

B. Any recreational vehicle in violation of this section may be removed and impounded in areas posted as designated by City Council resolution.

C. The provisions of this section shall not apply to any of the following:

  1. Vehicles making pick-ups or deliveries of goods, wares, or merchandise from or to any building or structure in nonresidential zones.

  2. Any vehicle involved in an emergency or any vehicle being repaired under emergency conditions but no more than 72 hours.

  3. Any vehicle belonging to federal, state, or local agencies.

  4. Any vehicle displaying a valid permit issued pursuant to Section 14.40.150.

  5. Vehicles authorized by the City Manager in writing upon a finding of personal or professional hardship.

D. Vehicles (singular or in combination) over 25 feet in length or nine feet wide are prohibited on South Coast Highway 101 (adjacent to Cardiff State Beach), Moonlight Beach, Swami's Beach, Grandview Beach, and Beacon's Beach Parking Lots during the peak season (between the Friday before Memorial Day through Labor Day). Tailgating is prohibited. No awnings, slide-outs, chairs, tables, barbeques, or other recreational equipment may be used that encroach into adjacent sidewalks, bike paths or other parking areas.

§ 14.40.150. Permit Process for Overnight Parking of Recreational Vehicles—Residents.

A. The City Clerk or designee shall issue a permit on an annual basis for overnight parking of a recreational vehicle to any resident of the City for 48-hour nonconsecutive time periods to allow for preparing the vehicle for travel and for unloading upon return if the vehicle will not create a safety hazard and meets the requirements stated in subsection B of this section. The permit shall indicate the address of the resident and shall state: "OVERNIGHT RECREATIONAL VEHICLE PARKING PERMIT."

B. Requirements for issuance of a recreational vehicle parking permit by residents:

  1. Proof the vehicle is stored in an off-site storage facility.

  2. The vehicle shall be parked in front of the permittee's property if possible or immediately adjacent to it if not possible.

  3. The vehicle shall not be used for overnight camping, lodging, sleeping, residing in or accommodation purposes.

§ 14.40.155. Permit Process for Overnight Parking of Recreational Vehicles for Bona…

A. The City Clerk or designee shall issue a permit for overnight parking of a recreational vehicle to any bona fide guest of a City resident for no more than seven consecutive days. No more than three such permits shall be issued to an address in any one 12-month period. The permit shall state the address of the City resident and shall state: "OVERNIGHT RECREATIONAL VEHICLE PARKING PERMIT."

B. Requirements for issuance of a recreational vehicle parking permit by guest or visitors of City residents:

  1. Certification by the resident that the permit is being issued for the benefit of a bona fide guest or visitor of the resident.

  2. The recreational vehicles shall be parked in front of the City resident's property.

  3. The vehicle shall not be used for overnight camping, lodging, sleeping, residing in or accommodation purposes.
