Sec. 23-35. - Required.

No person shall in any manner, or for any purpose, excavate a public area without first having secured a written permit therefor as provided for in this article, except that a public utility may proceed to do emergency repairs and secure the necessary permit during the next regular working day.

Sec. 23-36. - Application.

Any person desirous of excavating a public area shall first file application therefor with the department of public works on forms provided by the director. Such application shall set forth the name and residence or business address of the person making such application, and shall state in detail the location and area of each excavation intended to be made, and shall state the purpose for which the excavation is to be made and used. Such application shall be accompanied by the following:

(a) A plat showing the location of each proposed excavation and dimensions thereof, and such other details as the city engineer may require.

(b) A certificate of public liability insurance in an amount as set by the council from time to time.

(c) A certificate of property damage insurance in an amount of as set by the council from time to time.

(d) An agreement duly executed by the applicant indemnifying the city against liability shall also be filed with the application.

Sec. 23-37. - Conditions authorized; waiver.

(a) The director of public works shall establish such conditions for the permit as he finds necessary to protect the public using the public area and to protect present or prospective public improvements which may be maintained therein. In addition to other appropriate conditions, the following may be established:

(1) The time and dates on which the work may be done.

(2) The supervision and safety precautions to be employed, including the erection of barricades, warning lights, signals and signs, and the employment of personnel to direct traffic.

(b) The director may waive any of the above conditions for good cause.

Sec. 23-38. - Permit fees, bonds.

(a) Fee. Fees in such amounts as established by the council from time to time shall accompany the aforementioned application.

(b) Bond. An applicant shall deposit and maintain a cash bond with the city in an amount of five thousand dollars ($5,000.00). A single bond may be maintained for all work done within the city. The bond shall be not less than the aggregate amount required of all work not accepted as complete or five thousand dollars ($5,000.00), whichever is greater. The form of the bond for faithful performance shall be such that the city may proceed against the permit holder and his sureties on the bonds immediately upon any default, in payments for labor, materials, and/or supplies, and equipment, without waiting for the completion of work and the accumulation of damages. Said bond shall further warrantee the work done for a period of six (6) months following completion of said work.

(c) Waiver. The director of public works may waive any of the above conditions for good cause.

Sec. 23-39. - Permit time limit.

Any permit issued under this article shall become effective upon the deposit of the required fees. Such permit shall be effective for a period of thirty (30) days. A permit may be renewed for an additional thirty (30) days with the approval of the director of public works.
