Sec. 18-42. - Loitering between 11:00 p.m. and 4:00 a.m.

(a) Prohibited. It shall be unlawful for any minor under the age of seventeen (17) years to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between the hours of 11:00 p.m. and 4:00 a.m. of the following day.

(b) Exceptions. The provisions of paragraph (a) of this section do not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or when the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.

Sec. 18-43. - Responsibility of parent, etc., not to allow violations—Generally.

It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of seventeen (17) years to knowingly permit such minor to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places between the hours of 11:00 p.m. and 4:00 a.m. of the following day.

Sec. 18-44. - Same—Exceptions when minor accompanied by adult or on legitimate business.

The provisions of section 18-43 do not apply when the minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor or when the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.

Sec. 18-45. - Violation of article—Each violation constitutes separate offense.

Each violation of the provisions of this article shall constitute a separate offense.

Sec. 18-46. - Same—By minor.

Any minor violating the provisions of this article is guilty of a misdemeanor and shall forthwith be delivered to the juvenile court branch of the superior curt of the state, in and for the county for appropriate action.

Sec. 18-47. - Same—By parent, etc.

Any parent, guardian or other adult person coming within the provisions of this chapter for violation of any provision here is guilty of a misdemeanor and may be fined or imprisoned or both fined and imprisoned in accordance with the provisions of this Code.
