Sec. 16-420. - Definition.

As used in this article, "carwash" means any event which is advertised by any means whatsoever at a location where members of the public may receive cleaning services for their vehicles; for the benefit of a not for profit group, association or corporation; provided, however, it shall not mean any place of business which constitutes a carwash which has a current business license issued by the city.

Sec. 16-421. - Unlawful acts.

It shall be unlawful for any person to organize, conduct or operate a carwash, as enumerated in this article, except in conformity with the provisions of this article.

Sec. 16-422. - Application for site approval.

Prior to conducting or operating a carwash at any place within the city, a written application for site approval must be filed by the property owner or their authorized representative in the office of the enforcement official designated by the city manager at least two (2) working days before the first proposed event. The applicant shall apply on city forms designated for this purpose. A carwash site application fee may be set by the city council by resolution.

Sec. 16-423. - Location of carwash.

No carwash shall be conducted or operated except at an approved site within the city.

Sec. 16-424. - Days and hours of carwash.

A carwash shall be conducted only on any Saturday, Sunday or legal holiday. No carwash shall be conducted before 7:00 a.m. or after 7:00 p.m. on permitted days.

Sec. 16-425. - Signs.

Signs advertising a carwash for which a permit is required under this article may be placed or erected on the carwash premises, but not at any other location, subject to the following conditions.

(1) The permitted signs shall not exceed a total of ten (10) square feet in area.

(2) No such sign shall be displayed at times other than the permitted times of the carwash.

Sec. 16-426. - Site revocation.

Any site approval issued under this article may be revoked and any subsequent application within one year may be denied if any enforcement official finds that conduct of the carwash has created a public or private nuisance or has violated any provision of this article or other applicable law.

Sec. 16-427. - Wastewater; cleaning agents.

Wastewater generated by a car wash shall not be allowed to run into any street or across any sidewalk. If sewer systems exist on the site of the carwash, they must have adequate sand interceptors. The property owner shall require that all sand interceptors will be thoroughly cleaned after the event. The property owner shall require that cleaning agents used during the event are biodegradable.

Sec. 16-428. - Violation an infraction.

Violation of any provision of this article constitutes an infraction.
