Sec. 16-364. - Definitions.

As used in this article, the following terms shall have the meanings indicated in this section:

Identifiable marks shall mean the following: the place of publication, including city, state, county or province, the name of the managing editor, and the date of publication.

Magazine as used herein shall mean all periodicals, publications, reviews, digests, newspapers and gazettes printed or published for sale.

Sec. 16-365. - Information required to be filed with clerk.

(a) Any person who is selling magazines or books as defined herein or both, within the city limits shall file with the clerk of the city a statement of publication which shall contain the following information concerning any magazine or book offered for sale by seller which does not have all identifiable marks as defined in section 16-364 of this article:

(1) The name of each book or magazine;

(2) The specific place of publication and/or printing, including street address, mailing address, city, state and country or province of each such book or magazine;

(3) The name of the publisher of each such book or magazine;

(4) The name of the managing editor of the publisher of each such book or magazine;

(5) The mailing address of the publisher, including the street address, city, state, and country or province of each such book or magazine;

(6) If any such book or magazine is published more often than once, it shall specify for each such book or magazine how often and when it is published;

(7) The annual subscription rate to each such book or magazine, if any;

(8) The name, mailing address, street address, city, state, and country or province of the distributor or wholesaler which supplies each magazine or book to seller;

(9) The manner in which each book or magazine is transported to seller.

(b) Whenever any person who is selling or sells magazines or books, as defined herein, within the city limits and such person either places for sale or sells a magazine or book for which a statement of information is required by paragraph (a) of this section but for which a statement of publication has not been filed with the city clerk, such person shall file a statement of publication which contains all of the information which is required to be filed with the city clerk under paragraph (a) of this section within ten (10) days from the date of placing for sale, or selling, whichever date is the earliest, a magazine or book not previously listed on the statement of publication. All changes regarding the statement of publication including a change of any information which is required by paragraph (a) of this section shall be filed with the city clerk within ten (10) days after receiving notice of the change.
