3.36.010 - Alternative procedure for leasing city real property.¶
The following procedure is established for leasing city owned real property, which procedure shall be in addition, but as an alternative procedure, to that required by Sections 25526 through 25536 of the Government Code.

3.36.020 - Term.¶
The city council may lease for a term not exceeding ninety-nine (99) years any real property belonging to the city and not needed for city purposes during the term of the proposed lease.

3.36.030 - Intention to lease property.¶
Before ordering the lease of any property the city council shall, in a regular open meeting, adopt a resolution declaring its intention to lease such property, which resolution shall describe the property in such manner as to identify it, specify the minimum rental, and the terms upon which it shall be leased, shall call for bids on the proposed leasing and shall fix a time not less than three weeks thereafter for a public meeting of the council at its regular place of meeting, at which sealed proposals to lease will be received and considered.

3.36.040 - Resolution.¶
Notice of adoption of the resolution and of the time and place of holding the meeting shall be given by the clerk of the city council by posting a certified copy of said resolution in three public places in the city, not less than fifteen (15) days before the date of the meeting, and by publishing a certified copy thereof for not less than two weeks in a newspaper of general circulation published in the city.

3.36.050 - Written and oral bids.¶
The resolution may contain a provision that upon opening the written bids for the lease, oral bids shall be called for by the council, and if upon such call for oral bids any responsible bidder offers to lease the property for a rental exceeding by at least five percent of the highest written proposal, the highest oral proposal submitted by such person shall be finally accepted.

3.36.060 - Highest bid.¶
The city council must accept the highest bids submitted for leasing or else reject all bids.

3.36.070 - Acceptance.¶
The final acceptance by the city council may be made either at the same session at which the proposals are considered or at any meeting of said council held within the thirty days next following.

3.36.080 - Exception.¶
Leases of a duration not exceeding one year and which the city council finds have an estimated rental of not exceeding four hundred dollars ($400.00) may be entered into without first following the bidding and notice procedure in this chapter; provided, such leases excluded from such procedure shall be limited to an actual monthly rental in an executed lease of not exceeding five hundred dollars ($500.00) per month, the term thereof shall not exceed one year, and shall not be renewable.
