2.20.010 - Established—Composition.

There is established in the city, a fire department to consist of not more than thirty-five (35) members, the exact number to be determined from time to time by the city council.

2.20.020 - Officers.

The officers of the fire department shall consist of a chief, an assistant chief and such other officers as the city council shall from time to time deem necessary.

2.20.030 - Appointment of members.

Membership in the fire department shall be determined by the department, in a membership policy. Such membership policy shall be subject to approval by the city manager and shall be kept on file with the department and at city hall. Appointments within the department shall be made by the chief, with approval of the city manager.

2.20.040 - Meetings.

A regular meeting of the fire department shall be held on the Tuesday of each week at a place to be designated by the chief of the fire department, and at which the chief of the department shall preside.

2.20.050 - Duties of fire department generally.

It shall be the duty of the fire department to answer all fire alarms promptly and to properly care for all material and apparatus belonging to the fire department that may be entrusted to them, and to perform such other duties as shall be required of them by the chief of the fire department.

2.20.060 - Powers and duties of fire chief.

A. The fire department, all property and paraphernalia of the city belonging to the fire department and the apparatus for sounding fire alarms shall be under the control, management and direction of the chief of the fire department and he shall at all times be responsible therefor.

B. All officers and members of the fire department shall be subject to and shall obey the orders and directions of the chief of the fire department and shall obey all rules and regulations that shall, from time to time, be prescribed by the chief of the fire department and the city council.

C. The chief of the fire department shall inquire into the cause of every fire occurring within the city and shall keep a record thereof. He shall aid in the enforcement of all fire regulations of the city and shall report any violation thereof to the city council. He shall do and perform such other acts and things as are, from time to time, required of him by the council.

D. The chief of the fire department shall at least once each month inspect the city for the purpose of ascertaining whether the fire regulations of the city are being violated, and whether there exists any rubbish or combustible material likely to become ignited and cause fire.

E. The chief of the fire department shall, to the best of his ability, preserve order at all fires, and shall, whenever proper or necessary, call upon the chief of police or any other police officer to preserve order and make arrests, and to prevent interference with his orders or with the members of the fire department.

2.20.070 - Powers and duties of assistant fire chief.

The assistant chief of the fire department shall attend all fires and assist the fire chief in his duties on all occasions, and in the case of the absence or inability of the chief to act, the assistant chief shall have control of the fire department and in all respects perform the duties of the fire chief.

2.20.080 - Authority of fire department at fires.

No person, except by permission and under authority of the chief of the fire department, shall enter any burning building after the fire department has arrived at such building. When it is so ordered by the chief of the fire department, all persons shall move to a distance not less than fifty (50) feet from such building and to a distance of not less than twenty-five (25) feet from any apparatus of the fire department while going to or returning from any fire or while engaged in putting out any fire.

2.20.090 - Right-of-way of fire department equipment, personnel, etc., in streets.

All engines, hose and other movable apparatus belonging to the fire department, and the chief of the fire department, shall have paramount right-of-way through all streets, alleys and places in the city when going to or from any fire, and all persons shall give the fire department the unobstructed use of the street, either going to or returning from any fire, or while engaged at any fire.

2.20.100 - Nonliability of city for fire department activities.

No liability shall be incurred by the city on account of the fire department, except as shall be incurred or provided by the city council.

2.20.110 - Fire chief to be notified of turning off of water or closing of streets.

When for any reason the water is turned off from any fire hydrant, or whenever for any reason any street is closed, the chief of the fire department shall be immediately notified of the turning off of such water or of the closing of such street.

2.20.120 - Interference with fire department prohibited.

No person shall interfere with the chief of the fire department, his assistant or any member thereof while in the lawful performance of his duties, or refuse or neglect to obey the lawful orders or requirements of the fire chief or assistant fire chief.

2.20.130 - Injuring fire department apparatus prohibited.

No person shall wilfully or negligently injure or damage any house or place for the housing or protection of any machinery or apparatus of the fire department, nor injure any apparatus of the fire department.
