9.17.010 - Spray paint apparatus.

Within the limits of any publicly owned or operated property, as hereinafter defined, it is unlawful for any person to bring or have in his possession any spray paint can or any other apparatus designed or suitable for the application of paint to any surface by spraying paint upon such surface.

9.17.020 - Definition.

"Publicly owned or operated property," as used in this chapter, means any property which is used for public purposes and is either owned or occupied by any city, county, district, school district, other local authority or public body of or within this state.

9.17.030 - Exceptions.

The provisions of this chapter shall not apply to:

(a) Persons bearing a duly authorized written permit from the public agency involved to have such cans or apparatus in their possession while upon such publicly owned or operated property; and

(b) Persons engaged or employed by said public agency for the purpose of applying paint to surfaces within the limits of such publicly owned or operated property; and

(c) Persons upon and utilizing public streets or sidewalks for the purpose of passage in a usual and customary manner.
