10.16.010 - Purpose.

The purpose of this chapter is to promote and maintain the general health, safety and welfare of citizens residing or traversing the city streets or residential neighborhoods, by regulating and controlling the parking of all vehicles upon the streets and residential property within the City of Delano.

10.16.020 - Parking of certain vehicles.

It is unlawful for any operator to park any vehicle containing explosives or any petroleum, petroleum products or derivative including gasoline, butane and propane on any street or alley within the city except for the purposes of loading or unloading passengers or materials. It is unlawful for any operator to park any vehicle containing the abovementioned materials on any street or alley in the city for any purpose whatsoever for a period longer than twenty minutes.

10.16.030 - Parking prohibited on certain part of Eleventh Avenue.

Impoundment of vehicles left standing for seventy-two hours. Any regularly-employed and salaried officer of the police department of this city or the city manager or any city employee designated by her or him is authorized to remove and store vehicle which have been parked or left standing upon any public street or highway in the city for seventy-two or more consecutive hours.

10.16.040 - Parking prohibited on certain portion of Twentieth Avenue.

It is unlawful for the owner or operator of any motor vehicle, motorcycle, truck or any other vehicle of any nature, to park such vehicle along the western terminus of Twentieth Avenue along the south side of Twentieth Avenue for a distance of one hundred ninety feet from the edge of the crosswalk to the end of Twentieth Avenue where Twentieth Avenue ends.

10.16.050 - Parking prohibited on certain parts of High Street.

It is unlawful for the owner or operator of any motor vehicle, motorcycle, truck or any other vehicle of any nature, to park the vehicle along the easterly side of High Street within the city at any point between the south property line of Eleventh Avenue and a point forty feet southerly therefrom, and from the south property line of Twelfth Avenue and a point fifty feet southerly therefrom.

10.16.055 - Parking prohibited on certain part of Veneto Street.

It is unlawful for the owner or operator of any motor vehicle, motorcycle, truck or any other vehicle of any nature, to park the vehicle along either side of Veneto Street within the city at any point north of Primavera Drive.

10.16.060 - Parking prohibited along the north side of Eleventh Avenue one hundred feet…

It is unlawful for the owner or operator of any motor vehicle, motorcycle, truck or any other vehicle of any nature, to park the vehicle along the northerly side of Eleventh Avenue from the intersection of Glenwood Street one hundred feet west.

10.16.070 - Parking prohibited along the north side of Eighteenth Avenue to Girard…

It is unlawful for the owner or operator or any motor vehicle, truck, motorcycle or any other vehicle of any nature to park at any time along the north side of Eighteenth Avenue beginning at a point approximately fifty feet east of the intersection of Girard Street and Girard Street beginning at the intersection of Eighteenth Avenue proceeding to the first alley north of Eighteenth Avenue.

10.16.080 - Parking prohibited along the north side of Garces Highway at the intersection of Oxford Street.

It is unlawful for the owner or operator of any motor vehicle, truck or any other vehicle which is over seven feet or more in height (including any load thereon) to park at any time along the north side of Garces Highway within one hundred feet of the eastern boundary of the intersection with Oxford Street.

10.16.090 - Parking prohibited along the north side of the north entrance of Save Mart on Inyo Street.

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle, or any other vehicle of any nature to park at any time along the north or west side of Inyo Street beginning at a point approximately seventy-five feet south curb line of Seventeenth Avenue and continue approximately ten feet north of the north curb line of Seventeenth Avenue.

10.16.100 - Parking prohibited along the south side of Cecil Avenue at the intersection of Clark Street.

It is unlawful for the owner or operator of any motor vehicle, truck or any other vehicle which is over seven feet or more in height (including any load thereon) to park at any time along the south side of Cecil Avenue within one hundred feet of the western boundary of the intersection with Clark Street.

10.16.110 - Parking prohibited along the north and south side of Cecil Avenue.

It is unlawful for the owner or operator of any motor vehicle of any nature to park at any time along the north side of Cecil Avenue between Norwalk Street and Princeton Street, and along the south side of Cecil Avenue between Norwalk Street and Oxford Street.

10.16.120 - Parking prohibited in designated places.

It is unlawful for any person to park or stand any vehicle upon a street or highway:

A. Between the hours of nine a.m. and six p.m. when such parking or standing is prohibited by ordinance or resolution of this city and signs are posted giving notice of such removal;

B. Where the use of such street or highway or portion thereof is necessary for the cleaning, repair or construction of the street or highway or for the installation of underground utilities or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement; provided that signs giving notice that such vehicle may be removed are erected or placed at least twenty-four hours prior to the removal.

C. It is unlawful for any person to park or stand any vehicle where the street is posted for street sweeping on during certain times and days of the week, when the street is properly posted as such.

D. It shall be unlawful for any person to park or stand any vehicle on any street or roadway where there exist any commercial package, envelope, or letter drop-off receptacle for any period of time, or, if delivering any package, envelope, or letter to such commercial drop-off receptacle, it shall be unlawful for any person to park or stand any vehicle for a period no longer than five minutes on any street or roadway to deliver such package, envelope, or letter to the commercial drop-off receptacle.

10.16.130 - Parking in alleys.

A. As used in this section, "alley" means any street having a roadway not exceeding twenty-five feet in width which is primarily used for access to the rear or side entrances of abutting property.

B. No person shall stop, stand, or park a vehicle for any purpose other than the loading or unloading of materials in any alley in the city.

C. No person who shall stop, stand, or park a vehicle for the purpose of loading or unloading in any alley in the city shall leave the same unattended; but, at all times, the driver shall be available to move the vehicle in order that the alley may be kept open for traffic in any emergency.

D. In order to make the provisions of this section more effective, the director of public works is authorized to procure and have erected at locations approved by the chief of police, signs reading: "No parking in this alley. Loading and unloading permitted by order of police department or City Code Section 10.16.130."

10.16.140 - Parking restrictions for city hall parking lot.

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, other than emergency vehicles and school busses, to parking in any marked parking space at City Hall, after such proper posting has taken place in accordance with this chapter.

10.16.150 - Parking prohibited along the west side of Randolph Street south of Twentieth Avenue.

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, other than emergency vehicles and school buses, to park from 7:00 a.m. to 4:00 p.m. along the west side of Randolph Street beginning at a point approximately one hundred seventy-five feet south of Twentieth Avenue, continuing to three hundred twenty feet south of the west corner of Randolph Street and Twentieth Avenue.

10.16.160 - Parking prohibited during school hours along the west and north side of…

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, excluding school buses, to park at any time at the yellow curb marking bordering Fremont School on the west and north sides. The yellow curb markings are located along the east side of Clinton Street beginning at a point approximately three hundred seven feet south of the south curb line of Fourteenth Avenue and continue approximately two hundred fifty feet south, and at a point approximately two hundred eighty-five feet east, of the east curb line of Clinton Street and continue approximately two hundred twenty-two feet east.

10.16.170 - Parking prohibited along the north side of the south bus entrance of…

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, to park at any time along the west side of Norwalk Street beginning at a point approximately one hundred fifty-five feet south of the south curb line of Twentieth Avenue and continue approximately one hundred seventy feet south along the west curb of Norwalk Street.

10.16.180 - Parking prohibited on Girard Street from the north curb line of 21st Avenue…

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, to park at any time on either side of Girard Street beginning at the north curb line avenue extending north to the south curb line of County Line Road.

10.16.190 - Parking prohibited in the 1500 block of Albany Street at the red curbs.

It is unlawful for the owner or operator of any motor vehicle, truck, motorcycle or any other vehicle of any nature, to park at any time at the red curb marking in the one thousand five hundred block of Albany Street. The red curb markings are located along the east and west sides of the one thousand five hundred block of Albany Street. They begin at the south side of Cecil Avenue and continue approximately one hundred sixty-five feet south on the west curb, and continue approximately one hundred fifty feet south on the east curb.

10.16.200 - Procedure establishing parking zones.

The city council shall establish, delete or change parking zones by resolution.

10.16.210 - Parking zones established.

The following portions or street within the city are established as parking zones:

A. Glenwood Street from Ninth Avenue to Eleventh Avenue (west side of street only);

B. High Street from Tenth Avenue to Fourteenth Avenue (east side of street only);

C. Main Street from Ninth Avenue to Ceil Avenue (both sides of street);

D. Jefferson Street from Ninth Avenue to Eleventh Avenue (west side of street only);

E. Jefferson Street from Eleventh Avenue to Thirteenth Avenue (both sides of street);

F. Ninth Avenue from High Street to Jefferson Street (both sides of street);

G. Tenth Avenue from High Street to Jefferson Street (both sides of street);

H. Eleventh Avenue from High Street to Lexington Street (both sides of street);

I. Twelfth Avenue from High Street to Lexington Street (both sides of street);

J. Thirteenth Avenue from High Street to Jefferson Street (both sides of street);

K. Kensington Street from Eleventh Avenue to Twelfth Avenue (both sides of street).

10.16.220 - Parking more than two hours prohibited.

It is unlawful, for any person between the hours of nine a.m. and six p.m. of any day except Sunday and holidays, to cause, allow, permit or suffer any vehicle registered in his name, operated or controlled by him, to be parked in any space upon any street within the foregoing parking zones for more than a two-hour period.

10.16.230 - Parking of commercial vehicles is prohibited on street or building sites in…

No person shall park or leave standing any commercial vehicle defined in the Vehicle Code of the state, upon any street or private residential property within any residential district of the city, if such vehicle has a manufacturer's gross vehicle weight rating of ten thousand pounds or more, for any purpose other than making pickups or deliveries of person, goods, wares and merchandise from or to any building or structure, located on such street or for any purpose other than delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon such obtained. A residential district of the city is any area of the city which is classified as residential under the provision of the zoning ordinance regulations of this Code excluding any R-A (residential agricultural) zone.

10.16.240 - Refrigerated trucks.

Refrigerated units may not be operated on a standing truck whether on a public street or zones excluding the R-A (residential agricultural) zone district, except when engaged in immediate delivery.

10.16.250 - Truck parking zones.

The city council is authorized to determine and designate truck routes by resolution, which designation shall become effective when appropriate signs are in place giving notice of such designation to the public.

10.16.260 - Commercial vehicles with more than two axles allowed on certain streets on truck route.

The following certain portions of the streets lying within the corporate boundaries of the City of Delano, hereinafter referred to as the truck route are permissible for travel by any truck, truck tractor, trailer or any combination thereof normally used for hire, transporting or otherwise employed to gain commercial profit for the owner or operator:

A. East-West Routes.

  1. The south side of County Line Road, from Albany Street to the eastern city limit;

  2. Cecil Avenue, from the western city limit to the eastern city limit;

  3. Eleventh Avenue, from Albany Street to Lexington Street;

  4. Garces Highway, from the western city limit to the eastern city limit;

  5. Woollomes Avenue, from Albany Street (county road Stradley Avenue) to Garzoli Street and from Lexington Street to Browning Road;

  6. Schuster Road, from Albany Street (county road Stradley Avenue) to Garzoli Street and from Lexington Street to Browning Road;

  7. Pond Road, from Albany Street (county road Stradley Avenue) to Browning Road.

B. North-South Routes.

  1. Albany Street, from County Line Road to Pond Road;

  2. Ellington Street, from Cecil Avenue to First Avenue;

  3. Garzoli Street, from Woollomes Avenue to Pond Road;

  4. Fremont Street, from Cecil Avenue to First Avenue;

  5. High Street, from County Line Road to Woollomes Avenue;

  6. Girard Street, from County Line Road to High Street;

  7. Lexington Street, from Cecil Avenue to Schuster Road;

  8. Browning Road, from County Line Road to Pond Road.

C. In order to make the provisions of this section more effective, the director of public works is authorized to procure and have erected at locations approved by the city engineer, signs reading: "Commercial Truck Route permitted by order of City Code Section 10.16.260."

10.16.270 - Commercial vehicles with more than two axles restricted from streets not on truck route.

Except for the purposes listed in subsections A and B, it is unlawful for any person to drive, park or operate or cause to be driven, parked or operated any truck, truck tractor, trailer or any combination thereof normally used for hire, transporting or otherwise employed to gain commercial profit for the owner or operator on those certain portions of the streets within the corporate boundaries of the City of Delano not identified in the truck route shown in Section 10.16.260.

A. The provisions of this section shall not apply to the following purposes, provided, that the most direct route is used to restricted streets from the truck route and from the restricted street to the truck route:

  1. Pickups and deliveries of materials, goods, wares and merchandise from or to any building or structure;

  2. Bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted street for which a building permit has previously been obtained;

  3. Construction, installation or repair of any public utility, provided that the vehicle is owned by a public utility or licensed contractor;

  4. Transportation of persons by a common carrier;

  5. Construction, repair or maintenance of city streets, storm drains, water mains and sanitary sewers;

  6. Movie or television production under permit from the city.

B. The provisions of this section shall not apply to vehicles owner or operated by the city or its contractors, garbage, recycling and trash trucks licensed by the city, passenger buses under the jurisdiction of the community services department, any vehicle owned by a public entity while necessary in construction, installation or repair of any public utility and recreational vehicles.

10.16.280 - Parking of commercial vehicles is prohibited on certain streets in the truck route.

A. No person shall park or leave standing any truck, truck tractor, trailer or any combination thereof normally used for hire, transporting or otherwise employed to gain commercial profit on those certain portions of streets on the truck route as follows:

  1. Cecil Avenue, from High Street to Vassar Street;

  2. Eleventh Avenue, from Dover Street to Lexington Street;

  3. Garces Highway, from Fremont Street to Randolph Street;

  4. High Street, from Cecil Avenue to Garces Highway;

  5. Girard Street, from County Line Road to High Street.

B. The provisions of this section shall not apply to vehicles owned or operated by the city or its contractors, garbage, recycling and trash trucks licensed by the city, passenger buses under the jurisdiction of the community services department, any vehicle owned by a public entity while necessary in construction, installation or repair of any public utility and recreational vehicles.

C. In order to make the provisions of this section more effective, the director of public works is authorized to procure and have erected at locations approved by the city engineer, signs reading: "No Truck Parking by order of the City Code Section 10.16.280."

10.16.290 - Temporary unimproved parking facilities.

Unimproved temporary parking facilities may be operated in conjunction with public events not to exceed seven consecutive days. All temporary parking facilities may be approved by the planning department and conditioned to insure that adjacent properties are not unreasonably impacted.

10.16.300 - Parking restrictions operative twenty-four hours.

The disabled persons parking space restrictions set forth in this chapter shall be in force and operative twenty-four hours a day, everyday, holidays included, subject only to temporary parking and emergency parking prohibitions which may be established by the city.

10.16.310 - Application of certain vehicle code sections to privately-owned off-street parking facilities.

A. By resolution, the city council, pursuant to Vehicle Code Section 21107.8 as it now exists and as it may be amended from time to time, may find and declare that certain privately-owned and maintained off-street parking facilities as described in such resolution are within the city and are generally held open for use of the public for purposes of vehicular parking.

B. Upon enactment of the resolution, Sections 22350, 23103, 23109, 22507.8 and 22511.8 of the California Vehicle Code including, but not limited to, regulations pertaining to speed, speed contests, and reckless driving, shall apply to any such privately-owned and maintained off-street parking facilities described therein; except that:

  1. A resolution shall not be enacted pursuant to this section without a public hearing thereon and ten days' prior written notice to the owner and to the operator of the privately-owned and maintained off-street parking facility involved;

  2. An enacted resolution shall not apply to any off-street parking facility described therein unless the owner or each entrance at such off-street parking facility a notice not less than seventeen by twenty-two inches in size with lettering not less than one inch in height to the effect that such off-street parking facility is subject to public traffic regulations in control;

  3. Parking space in private facilities reserved for the exclusive use of disabled person' vehicles and veterans' vehicles displaying distinguishing license plates or placards shall be outlined on the parking surface by blue paint whenever feasible or on the curb or other raised paving adjacent to the reserved space. In addition to blue paint, the reserved space shall also be indicated by a sign consisting of a profile view of a wheelchair with occupant in white on a blue background posted immediately adjacent to a visible from each blue curb space at a height of eighty inches from the curb. A signs not less than seventeen by twenty-two inches in size shall also be conspicuously posted at each entrance of the off-street parking facility giving notice in lettering not less than one inch in height that the off-street parking facility is subject to public traffic regulations and control;

  4. An enacted resolution shall give the police department the authority to provide, but shall not require, patrol or enforcement of Vehicle Code Sections 22350, 23103, 23109, 25507.8 and 22511.8 on any privately-owned and maintained off-street parking facility unless required other than by action under this section.

C. Resolutions enacted pursuant to this section shall be filed with the city clerk and shall be made available to the public upon request.

10.16.320 - Tow-away authority.

Unauthorized vehicles not displaying distinguishing placards or license plates issued for physically handicapped persons unlawfully parked in a blue curb space may be towed away at owner's expense pursuant to the provisions of Vehicle Code Section 22500.8.

10.16.330 - Impoundment of vehicles left standing for seventy-two hours.

Any regularly-employed and salaried officer of the police department of this city is authorized to remove and store vehicle which have been parked or left standing upon any public street or highway in the city for seventy-two or more consecutive hours.

10.16.340 - Impoundment—Towing and storage charges.

Vehicles so removed shall be stored at any public storage place, and may be redeemed by the person or persons entitled thereto upon payment of the storage fees and any other storage, tow or miscellaneous fee incurred in connection with its removal and storage.

10.16.350 - Length of vehicles parked.

A. It is unlawful to stand or park any vehicle on a street with marked parking spaces except within such marked parking spaces; and at the angle to the curb indicated by such marking.

B. It is unlawful to stand or park any vehicle over twenty feet in length in any marked parking space on a public roadway or city-maintained parking lot within the city.

10.16.360 - Posting signs.

The city manager is authorized and directed to install signs in all parking zones established in this chapter or hereafter created by council, such signs being for the purpose of providing adequate notice of such parking regulations. The signs shall be permanent, shall be affixed at a raised level so as to be clearly visible, and shall be positioned no less than six hundred feet apart throughout such parking zones.

10.16.370 - Marking spaces.

The city manager will cause to have lines or markings painted or placed upon the curb or street and designating the parking space for each vehicle.

10.16.380 - Exceptions to chapter.

Nothing in this chapter shall be constructed to prevent the driving and operation of fire apparatus upon any streets of the city, nor shall this chapter by its terms prevent equipment owned by the city from being operated upon any streets of the city, neither shall this chapter by its terms be construed upon and over the streets of the city. The provisions of this section shall not apply to:

A. Passenger buses under the jurisdiction of the public utilities commission (school districts);

B. Any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility;

C. Any vehicle owned by the United States Postal Service, while in use for the collection, transportation or delivery of the United States Mail.

10.16.390 - Violations—Penalties.

Violation of any of these sections of this chapter is an infraction, punishable as provided in Section 10.10.020 of this Code.
