10.10.010 - Purpose.¶
The California Legislature through Vehicle Code, Section 40200 et seq. has made effective July 1, 1993, violations of local, state and federal regulations with respect to the standing of or parking of this chapter is to set forth penalties and administrative fees for and provide procedural standards for administrative collection, investigation and review process to insure that the collection of any fines, penalties or administrative fees regarding standing or parking violations shall be consistent with and pursuant to state law. This chapter shall establish fines, penalties, and administrative fees for all violations of Chapter 10 et seq.

10.10.020 - Penalties.¶

C. The above fines and penalty schedule is based on a single violation per citation. For multiple violations on any citation, an additional nine dollars and fifty cents penalty per violation shall be charged to the violator. Penalties remitted are separate from the ticket sign-off fees charged by the city as established by city resolution.
D. In the event fines and penalties are amended by the State of California, the chief of police, or his designee, shall be authorized to amend such fines and penalties contained within this section as may be required to comply with such changes by the State of California, without approval of the city council.
E. For those sections of the Vehicle Code or this Code regarding the standing or parking of vehicles which are not listed in subsections A or B, the parking penalty for violation of those sections shall be thirty-five dollars and if the fine is not paid as specified in this chapter, a late payment penalty of five dollars shall be added to the parking penalty.

10.10.030 - Administrative fee.¶
If the parking penalty is not paid within twenty-one days from the notice of parking violation or fourteen days of the first notice of delinquent parking violation and/or if the parking violation has not been successfully contested, a ten-dollar administrative fee and late payment/penalty will be added to, and included in the parking penalty.

10.10.040 - Late payment penalty.¶
If the fine is not paid within ten days of the second notice of delinquent parking violation, an additional late payment penalty equaling twenty percent of the total of the fine, penalties and administrative fees already assessed will be added to the fine.

10.10.050 - Administrative review.¶
A. Within twenty-one days from the notice of parking violation or fourteen days from the mailing of the first notice of delinquent parking violation, a person by either written request, telephone or in person may request, review by the city regarding the notice of parking violation or first notice of delinquent parking violation. This review is only to determine the validity of the citation. An administrative review request must be completed by the contesting party if the request is made in person, or by the city employee who receives a written or telephone request for such review. There shall be no charge for an administrative review of a parking citation. No administrative review will be only conducted if the violator contests the parking citation in the manner established by Section 40215(a) of the California Vehicle Code. Administrative review requests that falls outside of the time constraints listed in Section 40215(a), supra, will be denied by the hearing officer.
B. The results of the city's review shall be mailed by the hearing officer to the person seeking review within fifteen days of the request for the review. Denials of an administrative review will be mailed within five business days stating the reason the request for administrative review was made.

10.10.060 - Administrative hearing.¶
A. A person dissatisfied with the results of the investigation pursuant to Section 10.10.050 may request a hearing by depositing the full amount of the parking penalty with the city and providing a written explanation to the city as to why the parking violation is being contested within twenty-one days of the mailing of the results of the investigation.
B. The person requesting an administrative hearing shall indicate to the city his or her election for a hearing by mail or personal conference.
C. If the person requesting a hearing is a minor, that person shall be permitted to appear at a hearing or admit responsibility for a parking violation without the necessity of the appointment of a guardian. The city may proceed against that person in the same manner as if that person were an adult within ninety days of the request for hearing.
D. All administrative reviews and administrative hearings shall be conducted before a hearing officer designated by the city manager to conduct the review by the city.
E. The officer or person authorized to issue a notice of parking violation shall not be required to participate in the administrative hearing. The city shall not be required to produce any evidence at the hearing other than the notice of parking violation or copy thereof, and information received from the department of motor vehicles identifying the registered owner of the vehicle. The documentation in proper form shall be considered prima facie evidence of the violation.
F. The hearing shall be conducted in accordance with the written procedure established by the city which shall insure fair and impartial review of contested parking violations. The city's final decision may be delivered personally to the person by the examiner or to the person by first class mail within ten days of the hearing.

10.10.070 - Relief from deposit requirements.¶
The city will not require the deposit as stated in Section 10.10.060(A) from any person who can offer verifiable and substantial proof that he or she is either indigent or that their vehicle has been impounded or immobilized by the city and the vehicle will remain impounded or immobilized during the time he or she is contesting the parking violation. In indigent cases other than, when violator requests to make payments upon the results of an administrative review, and based upon financial hardship, the administration review officer may allow payments to the city. However, all fees must be paid within sixty days from approval.

10.10.080 - Alternative payment methods.¶
The hearing officer, with the approval of the city manager, may authorize a violator to makeup to six equal installment payments for parking violations and all applicable late payment penalties, if any, but in no case shall installments be made for more than one hundred eighty days from the date installments are authorized. Installment payments must be made at least once every thirty days during the term of the installment plan. If in the opinion of the hearing officer a severe financial hardship exists, the hearing officer may allow a violator to complete community service in lieu of paying all fees and late payment penalties, if any, associated with the violation(s). The actual number of hours of community service to be worked will be based on the prevailing California minimum wage per hour, divided by the fee to be paid by the violator. The hearing officer may assign violators to complete community service at city parks, police department, the golf course, vacant city property, or other location deemed appropriate by the hearing officer. All community service hours must be completed within ninety days from the approval of community service by the hearing officer.

10.10.090 - Trial de novo by court.¶
Within twenty days following the mailing of the city examiner's decision, an individual contesting a parking ticket may appeal to the justice or municipal courts. Although the hearing is de novo, the processing city's file in the case must be received into evidence and a copy of the notice of parking violation is deemed prima facie evidence of the facts provided. If the court decision is in favor of the city, and the agency may initiate collection efforts. If the contestant is successful in its appeal, the city shall reimburse to pay and will further refund any deposit contestant has made regarding contestant's parking penalty.

10.10.100 - Collection of unpaid parking penalties.¶
Once the contestant has allowed an administrative or court decision to become final by not taking timely advantage of a further administrative step or appellate proceeding; the violator has failed to make installments payments in the time provided; or, the violator has failed to complete the community service as agreed upon, the city may proceed to collect the parking penalties if a full deposit of the penalty has not already occurred, or any remaining fees and penalties owed to the city. Generally, only one of the following collection procedures may be pursued at any given time.
A. Collection with Vehicle Registration. The city may file an itemization of unpaid parking penalties and administrative and service fees with the department of motor vehicle (DMV) for collection with the registration of the vehicle.
B. Any fee that the city must pay to the department of motor vehicles in order to facilitate collection of unpaid parking penalties, late penalties and administrative service fees will be added to and become a part of the parking fine.

10.10.110 - Equipment and registration tab violation.¶
Equipment and registration tab violations will be handled in the same fashion as standing or parking violations, except the penalty for such violations is specified by state law.

10.10.120 - Hearing officer training requirements.¶
If appointed by the city manager, the hearing officer shall complete a minimum of twenty hours of training in accordance with the California Vehicle Code, Section 40215(B). Hearing officers shall not conduct any citation review or actual parking citation hearing until such time as the training requirements have been met. The city shall maintain a copy of the hearing officer's training certification.
