Chapter 17.56 — FP-2 - SECONDARY FLOODPLAIN ZONE

17.56.010 Intent – Purpose.

(A) It is intended by this chapter to establish a Secondary Floodplain Combining Zone, which shall apply to properties which lie within areas where inundation may be caused by overflow and backwater, which is relatively free of any current, excluding, however, those areas lying within an FP1 zone, but which require special regulations for the protection of such properties and their improvements from hazards and damages which may be caused from floodwaters.

(B) There is established a Secondary Floodplain Combining Zone, designated as FP-2, which, when shown upon the zoning map of the city in combination with a basic zoning symbol such as R-1, C-2 and M-2, shall cause the property so designated to be subject to the code provisions relating to such combining zone and the provisions set forth in this chapter.

17.56.020 Application of regulations.

The regulations set forth in this chapter shall apply to all zones with which are combined the FP-2 zone, in addition to the regulations specified in this title; provided, however, if any of the regulations specified in this chapter differ from any of the corresponding regulations specified in this title for any zone with which the FP-2 zone is combined, then in such cases the provisions of this chapter shall prevail.

17.56.030 Permitted uses.

The following uses are permitted in the FP-2 zone:

(A) All uses permitted in the respective zone with which the FP-2 zone is combined; provided, however, that the lowest inhabitable floor level of any buildings, structures and uses are above flood profile level as shown on the floodplain zoning map of the particular area in question;

(B) Crop and tree farming, truck gardening and other similar agricultural uses;

(C) Public and private parks and recreational uses, areas and facilities which have been designed to withstand inundation due to floods and will resist flotation in the event of flooding, including, but not limited to private

recreational trailer camps; provided, however, the camps are operated only on a seasonal basis and allow no auxiliary buildings or cabanas to be attached to a trailer located in the camp. (`78 Code, § 17.56.030.)

17.56.040 Conditional uses.

The following uses may be permitted by conditional use permit issued pursuant to the provisions of this chapter and Chapter 17.92:

(A) Improvements and additions to or modifications of existing permitted buildings and structures, the floor levels of which do not meet the requirements as stated in § 17.56.030(A);

(B) All uses permitted in the respective zone with which the FP-2 zone is combined, when properties which lie within a FP-2 zone have been protected by manmade dikes or levees, not constructed by local, state or federal

agencies solely for the protection of the area so zoned or by private persons according to the construction standards followed by local, state or federal agencies in their construction of said protective barriers. (`78 Code, § 17.56.040.)
