Chapter 17.106 — ZONING ORDINANCE TEXT AMENDMENT

17.106.010 Procedure – Compliance required.

Any amendments to the text of the ordinance codified in this title which imposes any regulation not heretofore imposed or removes or modifies any such regulation theretofore imposed shall be made according to the procedure set forth in this title.

17.106.020 Initiation.

(A) The Planning Commission may initiate proceedings by motion and then hold public hearings and make a recommendation as provided in this chapter.

(B) The City Council may initiate proceedings by motion and then submit the matter to the Commission for public hearings.

17.106.030 Staff investigation.

The Planning Department shall study the proposed amendment and shall provide information necessary to assure action consistent with the intent of this title and the General Plan and shall report the findings to the Commission. (`78 Code, § 17.106.030.)

17.106.040 Public hearing – Commission – Notice.

(A) The hearing date shall be set by the Secretary of the Planning Commission for not less than ten, nor more than 45 days after the initiating motion by the Commission or Council.

(B) The notice of time, place and purpose of the hearing shall be published once in a newspaper of general circulation in the city not less than ten days prior to the date of hearing. The title of such notice shall consist of words "NOTICE OF PROPOSED AMENDMENT TO ZONING ORDINANCE" in larger type than that used for the balance of the notice.

17.106.050 Public hearing – Commission – Recommendation.

(A) The Commission shall, not less than ten days after the publication of the legal notice of a public hearing on an amendment, hold the public hearing.

(B) Within 35 days after the conclusion of the public hearing, the Commission shall file its recommendation with the Council, together with a report of findings, hearings and other supporting data. (`78 Code, § 17.106.050.)

17.106.060 Public hearing – Council – Date and notice.

(A) The hearing date shall be set by the City Clerk for not more than 30 days after the filing of the Commission’s recommendation.

(B) Notice shall be given as provided in § 17.106.040(B). (`78 Code, § 17.106.060.)

17.106.070 Public hearing – Council – Decision.

(A) The Council shall not less than ten days nor more than 30 days after the publication of the legal notice of a public hearing on an amendment, hold the public hearing.

(B) The Council may adopt by ordinance the amendment recommended by the Commission after holding at least one public hearing thereon. The Council may modify the amendment recommended by the Commission; provided the proposed modification has been referred back to the Planning Commission for a report pursuant to division (C) of this section.

(C) The Commission shall review the changes proposed and referred to it by the Council and shall report its recommendations back to the Council, the report to be filed with the Council not more than 40 days after the referral by the Council.

17.106.080 Minor amendments.

Minor zoning ordinance text amendments which neither impose new regulations nor remove or modify existing regulations may be initiated and adopted as other ordinances are initiated and adopted. (`78 Code, § 17.106.080.)

17.106.090 Additional uses.

Any amendment to the text of the ordinance codified in this title which permits a use in a specific district or number of districts and where the use is not listed in any other districts in this title shall follow the procedures set forth in this chapter.
