15.24.010 - Definitions.

The meaning of terms set forth in this chapter Shall have the meaning as defined in the Zoning Ordinance.

15.24.020 - Classification.

All Fences and Walls in the City, whether constructed or of natural growth, Shall be classified as follows:

A. Class 1: masonry, cement, or similar type Material;

B. Class 2: ornamental iron or similar type Material;

C. Class 3: woven wire with either wood or metal posts;

D. Class 4: wooden Material (or similar type Materials) where at least fifty percent of the area remains open;

E. Class 5: all Fences not otherwise classified directly or indirectly, including Hedges or other objects of natural growth, creating an Enclosure or sight-restrictive object.

15.24.030 - Height and location.

A. No Fence or Wall in excess of three feet in height Shall be Permitted in the Front Yard Setback area or the Side Yard of a Corner Lot adjacent to a Key Lot of any residential Property except as provided herein. Fences of Class 3 Shall be Permitted in said Front Yard providing such Fence Shall not exceed five feet in height and the openings Shall not be obscured in any way nor designed in any way to interfere with Pedestrian or auto Driver view.

B. No Fences or Walls in excess of six feet Shall be Permitted in the side or Rear Yard of any Property except as follows:

  1. Fences and Walls in a Buildable Area May exceed six feet.

  2. Fences and Walls protecting storage Yards or a legal Business or of a public Utility Yard May exceed six feet.

C. No Class 3 Fence constructed of chicken wire or similar thin wire of less than twenty gauge Shall be Permitted.

D. No Fence Shall be Permitted in the public Right-of-Way.

E. No Wall or Fence Shall be Permitted where said Wall or Fence will impede the City Electric Department meter reader to physically reach the meter and be able to read it from a straight forward position within six inches from the meter face.

15.24.040 - Fences required—Pools.

A. Any Fence or Wall which is Approved by the Zoning Ordinance May be Used to protect a pool area so long as the Fence or Wall meets the Following requirements:

  1. That openings in the Fence/Wall not be wider than four inches;

  2. That a ladder effect is not produced by the openings;

  3. That the height of the Fence/Wall be a minimum of five feet as measured from the top of the outside Grade.

B. Said Fence/Wall Shall be maintained on the Lot or Premises upon which is situated a Swimming Pool, portable, or aboveground type pools, or other open areas of water including reservoirs, sumps, and irrigation ditches where the water level is higher than eighteen inches.

C. Such Fence or Structure Shall completely surround such pool or area and all Gates or doors opening through such Enclosures Shall be equipped with self-closing and self-latching devices designed to keep such opening securely closed at all times when not in actual Use. The door of any Structure forming any Part of the required Enclosure need not be so equipped.

15.24.050 - Electric and barbed wire Fences.

A. No Fence Shall be charged in any way with electricity or contain in whole or Part barbed wire or sharp prongs or edges except as provided in this section.

  1. Barbed wire Fences May be placed on grazing land or along section lines.

  2. Barbed wire May be placed atop a Fence which protects a storage or public Utility Yard.

  3. Fences with less than twenty-four volts May be placed in Agricultural Zones for the keeping of animals.

15.24.060 - Maintenance.

All Fences Shall be kept in a state of repair so as not to be Hazardous or dangerous and those Used to protect the general public Shall be maintained so as to be sufficient and adequate for that purpose. All Fences Shall be neatly maintained so as not to be unsightly.

15.24.070 - Enforcement.

A. The Community Development Department is specifically charged with the enforcement of the provisions of this chapter.

B. Any Person erecting or constructing any Wall higher than four feet within the City Shall obtain a Permit from the City Community Development Department prior to said construction or erection. The Fee for such Permit Shall be as fixed by Resolution of the City Council.

C. All concrete Block Walls over four feet high Shall be built per City Standards or of Approved design to be Approved and submitted by a California State Registered Engineer or Architect.

D. Variances from the criteria enumerated in this chapter May be granted as prescribed in the City's Zoning Ordinance for Minor Variances.

15.24.080 - Penalty.

Any Person violating any provisions of this chapter Shall be guilty of a misdemeanor and upon conviction thereof Shall be punishable by a fine of not more than five hundred dollars or by imprisonment in the County Jail for a period of not longer than six Months or by both such fine and imprisonment.
