Sec. 94-136. - Definitions.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Authorized emergency vehicle means all authorized emergency vehicles as defined in Vehicle Code §§ 100—680.

Private road or driveway means as defined in Vehicle Code § 490.

Public highway means any highway, road, street, way or place of whatever nature open to the use of the public for purposes of vehicular travel.

Vehicle means a device in, upon or by which any person or property is or may be propelled, moved or drawn upon a public highway, including a bicycle or such other vehicle of propulsion moved by human power.

Sec. 94-137. - Obstruction unlawful.

It is unlawful for any person to operate, drive, stop or park any vehicle upon the public highways or any private road or driveway so as to interfere with or obstruct the operation of any authorized emergency vehicle.

Sec. 94-138. - Driving near when siren sounds.

It is unlawful for any person operating any vehicle upon the public highways or any private road or driveway to operate or drive any vehicle in the same direction that any authorized emergency vehicle is traveling while the emergency vehicle is giving audible signal by siren, and has at least one lighted lamp exhibiting a red light visible under normal atmospheric conditions, from a distance of 500 feet to the front of such vehicle, until such authorized emergency vehicle shall be at least 500 feet distant. It is unlawful for any person to operate or drive any vehicle so as to approach within 500 feet of such authorized emergency vehicle, giving audible signal by siren and having at least one lighted lamp exhibiting a red light visible under normal atmospheric conditions from a distance of 500 feet to the front of such vehicle.

Sec. 94-139. - Approaching scene of emergency.

It is unlawful for any person to operate any vehicle upon the public highways or any private road or driveway so as to approach within 1,000 feet of any authorized emergency vehicle when such authorized emergency vehicle is engaged in extinguishing fire or when the authorized emergency vehicle is actively engaged at the scene of any bombing, act of sabotage, accident, explosion, flood, riot, earthquake or any emergency.

Sec. 94-140. - Parking near scene of emergency.

It is unlawful for any person to park, stop or abandon any vehicle within 1,000 feet of any authorized emergency vehicle when the authorized emergency vehicle is actively engaged at the scene of any bombing, act of sabotage, accident, explosion, flood, riot, earthquake or any emergency.

Sec. 94-141. - Assembling near scene of emergency.

It is unlawful for any persons to gather, collect, assemble or congregate within 1,000 feet of the scene of any fire, bombing, act of sabotage, accident, explosion, flood, riot, earthquake or any emergency when any authorized emergency vehicle is actively engaged at the scene.

Sec. 94-142. - Exemptions.

This division does not apply to the following:

(1) All authorized emergency vehicles and persons operating the authorized emergency vehicles.

(2) Any person lawfully ordered to do otherwise by any public officer or firefighter.

Sec. 94-143. - Penalty for violation.

Any person who violates any section of this division is guilty of a misdemeanor and, upon conviction, shall be punished as provided in section 1-21.
