Sec. 2-176. - Adopted.¶
In order to establish an equitable and uniform system for dealing with personnel matters and to comply with applicable laws relating to the administration of the personnel process, the personnel system in this division is hereby adopted.

Sec. 2-177. - Definitions.¶
The terms used to administer the personnel system shall be defined in the personnel rules and regulations.

Sec. 2-178. - Administration.¶
The city manager shall administer the city personnel system and may delegate his or her powers and duties under this division to a personnel officer, may delegate the appointing authority granted by the city council to any other officer or employee of the city, or may recommend that such powers and duties be performed under contract. The city manager shall:
(1) Act as the appointing authority for the city as to all employees, except elective officers and the city attorney.
(2) Prepare and recommend to the city council personnel rules and revisions and amendments to such rules.
(3) Direct the preparation of a classification plan, including class specifications including revisions to that plan.
(4) Have the authority to discipline employees in accordance with this division and the personnel rules of the city.

Sec. 2-179. - Applicability.¶
This division shall apply to all offices, positions and employment in the service of the city, except elective officers of the city, council-appointed officials and department heads and other exceptions as defined in the personnel rules.

Sec. 2-180. - Adoption and amendment of rules.¶
Personnel rules shall be adopted by resolution of the city council.

Sec. 2-181. - Appointments.¶
Appointments of city employees shall be based upon merit and fitness as determined by competitive examination. The probationary period shall be considered an extension of the examination process. Medical, physical, psychological or drug tests may be given as part of the examination.

The city manager or any appointing power shall have the authority to demote, discharge, reprimand, reduce in pay or suspend any regular city employee for cause in accordance with procedures included in the personnel rules. Any employee in the competitive service shall have the right of appeal, as defined in the personnel rules.

Sec. 2-183. - Layoff and reemployment.¶
Layoff and reemployment actions of city employees shall conform to pertinent provisions of state law and any local provision pursuant to state law.
