5.40.010 - Intent.¶
It is the intent of this chapter to provide compatibility between yard sales and the right to privacy and enjoyment of adjacent properties. Additionally, these regulations are intended to prevent the expansion of commercial operations into noncommercial areas.

5.40.020 - Purpose.¶
The purpose of this chapter is to prevent detrimental effects on the surrounding community from yard sale activities. The regulations are designed to protect the well being of residential neighborhoods, prevent depreciation of property values, and prevent commercial enterprises in non commercial areas.

5.40.030 - Definitions.¶
"Yard Sale" means any event, other than a sales activity operated in conjunction with a regularly licensed commercial or retail operation, which is advertised by any means whatsoever as a place or location to which members of the public, at any time, may purchase identifiable or tangible personal property. Also included in this definition are garage sales, patio sales, rummage sales, or any other similar such similar sales. Swap meets are specifically excluded from this definition and not permitted under this chapter.

5.40.040 - Conduct regulated.¶
A. All sale activities shall be conducted behind the property line. At no time shall the sale of goods be conducted on the public right-of-way.
B. All signs, whether on-site or off-site, shall comply with Chapter 16 of this code.

5.40.050 - Frequency.¶
An individual seller, household, group, house address or location, shall be permitted two yard sales per year. The length of time per yard sale shall not exceed three consecutive days. Hours for the yard sale shall be limited to between eight a.m. and eight p.m., each day.

5.40.060 - Inspection—Enforcement.¶
All property for sale shall be accessible for inspection at all times during the yard sale by the fire, police, health and other city officials.

5.40.070 - Violation—Penalty.¶
Any person violating any of the provisions of this chapter is guilty of an infraction with a fine of fifty dollars for the first offense, one hundred dollars for the second offense within one year, and two hundred fifty dollars for the third offense within one year.
