5.14.010 - Game arcade, principal use defined.

"Game arcade, principal use" means any place of business containing four or more games of skill or science, whether or not associated with another use.

5.14.020 - Permit, license requirements.

A. Game arcade applicants shall comply with the provision for obtaining a business license as set forth in Chapter 5.12, titled Coin-operated Machines.

B. Review of the operation permitted by the license is required every six months for a period of two years beginning on the date of the start of operation of a principal use game arcade.

5.14.030 - Locational criteria.

A. Game arcades shall only be permitted within the GC (General Commercial) zoned districts within the city.

B. Public entrances to a game arcade shall be:

  1. A minimum walking distance of two hundred feet from any residentially zoned property, church, or religious institution;

  2. A minimum walking distance of three hundred feet from any public or private elementary, intermediate or high school which provides education for at least fifty students;

  3. A minimum walking distance of fifty feet from any business devoting over fifty percent of its floor area to the sale of alcoholic beverages for off-site consumption.

C. Amusement devices and/or game arcades shall be prohibited within any business devoting over fifty percent of its floor area to the sale of alcoholic beverages for off-site consumption.

5.14.040 - Hours of operation.

Game arcades located within a walking distance of one thousand feet of a public or private elementary, intermediate or high school which provides education to at least fifty students shall not be permitted to be open for business during school hours and not until at least thirty minutes after the school(s) day officially ends. These limitations shall not apply on weekends, holidays or official school vacation periods.

5.14.050 - Supervision and security.

Game arcades as a principal use shall provide the following:

A. No admittance of juveniles under sixteen years of age until one-thirty p.m., except on Saturday, Sunday, holidays and school vacations;

B. No one under twelve years of age shall be admitted after eight p.m., unless accompanied by a responsible adult;

C. One attendant, twenty-one years of age or older, shall be on duty at all times during business hours;

D. Business may only be conducted between ten a.m. and ten p.m. The city council may approve extended hours of operation for good cause. In any case, after ten p.m.. attendance shall be limited to adults and minors accompanied by a parent or legal guardian.

5.14.060 - Public restrooms—Minimum requirement.

Game arcades shall provide a minimum of two public restrooms within the approved building.

5.14.070 - Change-making or token facilities—Required.

Game arcades shall provide change-making machines or token exchange facilities for patron use. Whatever facility is utilized, it shall be such so as to discourage patrons from requesting change from other patrons or nearby businesses or persons.

5.14.080 - Provision of bicycle racks.

Game arcades shall be required to provide bicycle rack stalls at the rate of one-half space per machine.

5.14.090 - Miscellaneous requirements.

A. Game arcades shall be required to provide sufficient and adequate lighting to provide for a safe and functional exterior environment.

B. Prior to occupancy, the arcade applicant shall take all necessary steps in order to comply with the requirements of the building, police and fire departments which may be imposed as a result of applicable codes or community objectives.

C. No sound created by the arcade or its patrons shall be detected from the exterior of the arcade or from adjacent stores or offices.
