16.34.400 - Standards of construction.

In all areas of special flood hazard, the following standards are required:

A. Anchoring.

  1. All new construction and substantial improvements shall be anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy.

  2. All manufactured homes shall meet the anchoring standards of Section 16.34.440A.

B. Construction Materials and Methods.

  1. All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage.

  2. All new construction and substantial improvements shall use methods and practices that minimize flood damage.

  3. All new construction and substantial improvements shall be constructed with electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities that are designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding.

  4. Within Zones AH or AO, adequate drainage paths around structures on slopes to guide floodwaters around and away from proposed structures.

C. Elevation and Floodproofing.

  1. New construction and substantial improvement of any structure shall have the bottom of the floor slab, lowest floor beam or basement floor elevated to a minimum of 1.0 foot above the base flood elevation. Nonresidential structures will meet the standards in subsection C3 of this section. Upon completion of the structure the elevation of the lowest floor, including the basement, shall be certified by a registered professional engineer or surveyor or verified by the local building inspector that the elevation requirements have been met. Notification of compliance shall be recorded as set forth in Section 16.34.320C.

  2. New construction and substantial improvement to any structure in a Zone AO shall have the bottom of the lowest floor beam or basement floor elevated above the highest grade at least as high as the depth number specified on the Flood Insurance Rate Map (FIRM). If there is no base flood depth number specified on the Flood Insurance Rate Map (FIRM), the bottom of the lowest floor beam or basement floor shall be elevated to two feet above the highest adjacent grade.

Nonresidential structures will meet standards in subsection C3 of this section. Upon completion of the structure, compliance to the elevation requirement shall be certified by a registered professional engineer or surveyor or verified by the local building inspector. Notification of compliance shall be recorded as set forth in Section 16.34.320C.

  1. Nonresidential construction shall either be elevated in conformance with subsections C1 or C2 of this section or, together with attendant utility and sanitary facilities, be floodproofed to the base flood elevation. Certification is required by a registered professional engineer or architect that the standards of this subsection are satisfied and that the floodproofing methods are adequate to withstand the floor depths, pressures, velocities, impact and uplift forces and other factors associated with the base flood. Such certification shall be provided to the director as set forth in Section 16.34.320C1. Examples of floodproofing include, but are not limited to:

a. Installation of watertight doors, bulkheads and shutters;

b. Reinforcement of walls so that they are substantially impermeable to the passage of water;

c. Use of paints, membranes or mortars to reduce seepage through walls which have the capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy;

d. Addition of mass or weight or tiedowns to structure to resist flotation;

e. Armour protection of all fill materials from scour and/or erosion.

  1. Manufactured homes shall meet the above standards and also the standards in Section 16.34.440.

  2. All new construction or substantial improvements with fully enclosed areas below the lowest floor shall be designed to automatically equalize the hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwaters. Designs must be certified by a registered professional engineer or architect or have at least one square inch per square foot of flooded area. The openings shall be no more than one foot above grade.

16.34.410 - Standards for storage of materials and equipment.

A. In areas of special flood hazard the storage or processing of materials that are, in time of flooding, buoyant, flammable, explosive, or could be injurious to human, animal, or plant life, is prohibited.

B. Storage of other material or equipment may be allowed if not subject to major damage by floods and firmly anchored to prevent flotation or if readily removable from the area within the time available after flood warning.

16.34.420 - Standards for utilities.

A. All new and replacement water supply and sanitary sewage systems shall be designed to minimize or eliminate infiltration of floodwaters into the system and discharge from systems into floodwaters.

B. On-site waste disposal systems shall be located to avoid impairment to them or contamination from them during flooding.

16.34.430 - Standards for subdivisions.

A. All preliminary subdivision proposals shall identify the flood hazard area and the elevation of the base flood.

B. All final subdivision plans shall provide the elevation of proposed structure(s), pads, and adjacent grade. If the site is filled above the base flood, the final pad elevation shall be certified by a registered professional engineer or surveyor and provided to the official as set forth in Section 16.34.320C1.

C. All subdivision proposals shall be consistent with the need to minimize flood damage.

D. All subdivision proposals shall have public utilities and facilities such as sewer, gas, electrical, and water systems located and constructed to minimize flood damage.

E. All subdivision proposals shall have adequate drainage provided to reduce exposure to flood damage as set forth in Section 16.34.320C1. Certification of compliance shall be required by the developer.

16.34.440 - Standards for manufactured homes and manufactured home parks and subdivisions.

A. 1.

All new manufactured homes and additions to manufactured homes shall be installed using methods and practices which minimize flood damage, and shall be set on permanent foundation by anchoring the unit to resist flotation, collapse, or lateral movement by one of the following methods:

a. By providing an anchoring system designed to withstand horizontal forces of fifteen pounds per square foot and uplift forces of nine pounds per square foot; or

b. By the anchoring of the unit's system, designed to be in compliance to the Department of Housing and Urban Development Mobile Home Construction and Safety Standards; or

c. By bolting the frame or undercarriage to a reinforced, permanent foundation such as a retaining wall or storm wall used to set the unit;

d. By use of over-the-top or frame ties to ground anchors.

  1. These requirements are in addition to applicable state and local requirements for resisting wind forces.

  2. As set forth in Section 16.34.320C1, certification meeting the standards above is required of the installer or state agency responsible for regulating the placement, installation and anchoring of individual manufactured home units.

B. The following standards are required for:

  1. Manufactured homes not placed in manufactured home parks or subdivisions;

  2. New manufactured home parks or subdivisions;

  3. Expansions to existing manufactured home parks or subdivisions; and

  4. Repair, reconstruction or improvements to existing manufactured home parks or subdivisions that equal or exceed fifty percent of the value of the streets, utilities and pads before the repair, reconstruction or improvement commenced:

a. Adequate surface drainage and access for a hauler shall be provided,

b. All manufactured homes shall be placed on pads or lots elevated on compacted fill or on pilings so that the lowest floor of the manufactured home is at or above the base flood level. If elevated on pilings:

i. The lots shall be large enough to permit,

ii. The pilings shall be placed in stable soil no more than ten feet apart, and

iii. Reinforcement shall be provided for pilings more than six feet above ground level.

C. Despite subsection B of this section, no manufactured home shall be placed in a floodway. This provision does not apply to manufactured homes placed in an existing manufactured home park or existing manufactured home subdivision.

D. Certification of compliance is required of the developer responsible for the plan or state agency responsible for regulating manufactured home placement.

E. Manufactured homes that are placed or substantially improved within zones A1-30, AH, and AE on the city's FIRM on sites:

  1. Outside of a manufactured home park or subdivision;

  2. In a new manufactured home park or subdivision;

  3. In an expansion to an existing manufactured home park or subdivision; or

  4. In an existing manufactured home park or subdivision on which a manufactured home has incurred "substantial damage" as the result of a flood, must be elevated on a permanent foundation such that the lowest flood level of the manufactured home is elevated to or above the base flood elevation and be securely anchored to an adequately anchored foundation system to resist flotation collapse and lateral movement.

F. Manufactured homes to be placed or substantially improved on sites in an existing manufactured home park or subdivision within zones A1-30, AH, and AE on the city's FIRM that are not subject to the provisions of Section 16.34.440E must be elevated so that either:

  1. The lowest floor of the manufactured home is at or above the base flood elevation; or

  2. The manufactured home chassis is supported by reinforced piers or other foundation elements of at least equivalent strength that are no less than thirty-six inches in height above grade and be securely anchored to an adequately anchored foundation system to resist flotation, collapse, and lateral movement.

G. Recreational vehicles placed on sites within zones A1-30, AH, and AE on the city's FIRM must either:

  1. Be on the site for fewer than one hundred eighty consecutive days;

  2. Be fully licensed and ready for highway use; or

  3. Meet the permit requirements of this section and the elevation and anchoring requirements for "manufactured homes" of Section 16.34.440E.

A recreational vehicle is ready for highway use if it is on its wheels or jacking system, is attached to the site only by quick disconnect type utilities and security devices, and has no permanently attached additions.

H. A plan for excavating residents of all manufactured home parks or subdivisions located within flood prone areas must be developed and filed with and approved by appropriate community emergency management authorities.

16.34.445 - Standards for recreational vehicles.

All recreational vehicles placed on sites within Zones A1-30, AH, AO and AE on the city's Flood Insurance Map will either:

A. Be on the site for fewer than one hundred eighty consecutive days;

B. Be fully licensed and ready for highway use. A recreational vehicle is ready for highway use if it is on its wheels or jacking system, is attached to the site only by quick-disconnect type utilities and security devices, and has no permanently attached additions; or

C. Meet the permit requirements of Section 16.34.440(A).

16.34.450 - Floodways.

Areas designated as floodways are located within areas of special flood hazard established in Section 16.34.200. Since the floodway is an extremely hazardous area due to the velocity of floodwaters which carry debris, potential projectiles, and erosion potential, the following provisions apply:

A. Encroachments into the floodway shall be prohibited, including fill, new construction, substantial improvements, and other development which would increase flood elevations during the occurrence of the base flood discharge, unless certification by a registered professional engineer is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge.

B. If no floodway is identified, the permit holder shall provide an engineering study for the project area that establishes a setback where no encroachment of any new development will be allowed that would increase the water surface elevation of the base flood plus one foot; or establish a setback from the stream bank equal to five times the width of the stream at the top of the bank or twenty feet on each side from the top of the bank, whichever is greater.
