16.24.010 - Conditional use permit required.

No person shall conduct, carry on, cause or permit to be carried on nor use any property for the purpose of quarrying, mining, or excavating for the purpose of selling or using at some other location earth, sand, gravel or clay or other mineral products without a conditional use permit therefor issued by the city council pursuant to this chapter.

16.24.020 - Issuance.

No conditional use permit for any of the uses specified in Section 16.24.010 shall be issued except in accordance with the provisions of this chapter.

16.24.030 - Application—Contents.

Before any conditional use permit is issued an application shall be filed with the planning department. The application shall contain the following:

A. Description of the property upon which the use or activity is to be conducted;

B. The name of the owner;

C. The name of the person who will be carrying on the activity;

D. The length of time for which such activity shall be carried on;

E. The quantity of material estimated to be removed;

F. The manner of excavation or removal;

G. Map showing the topography of the area on which the use is to be conducted;

H. The planning director may require additional information as may be necessary.

16.24.040 - Hearing by commission.

After the application is filed the planning director shall set the matter for hearing before the planning commission and shall give notice of such hearing in the manner required for notice of zone exceptions.

16.24.050 - Recommendations.

A. The planning commission shall hear the matter and report its recommendations to the city council. The planning commission recommendation may be for granting the use as requested, for denying the use or for granting the use with such modification and conditions attached as may be necessary in the opinion of the commission to preserve the interests of the community and to further the purpose of the zoning ordinance, as codified in Title 19 of this code.

B. In determining the action to be taken relative to such application the planning commission shall consider:

  1. The zoning of the area in which the property is located;

  2. The proximity of the proposed use to any land used or zoned for residential purposes;

  3. The effect of the proposed use upon surrounding territory;

  4. The effect of the proposed use by reason of the change of topography upon the community at large and the adjacent territory including such effect as it may have upon drainage courses, runoff and the like;

  5. The effect of the proposed use upon the city road system and traffic movement;

  6. The effect of the proposed use upon the environment.

16.24.060 - Hearing by council.

The planning commission after concluding its public hearing shall make a written report to the city council setting forth its findings and recommendations. The city council may adopt the recommendation of the planning commission with or without a hearing as it deems advisable, but the city council may not modify or disapprove the decision of the planning commission until after having held a public hearing thereon. Notice of such hearing shall be given in the same manner as the notice of hearing before the planning commission. The city council in reaching its decision shall consider those matters required to be considered by the planning commission.
