16.32.010 - Maintenance deposits established—Reimbursement of city expenses.¶
The developer of any project requiring traffic control, landscape and/or irrigation improvements upon a public right-of-way shall deposit with the city, concurrently with submittal of the final map or issuance of a building permit, whichever occurs first, a maintenance deposit in an amount established by resolution of the city council for each such improvement. If the actual cost of maintenance described in Section 16.32.020 exceeds the amount of the deposit, the developer shall reimburse the city for any maintenance costs incurred in excess of the deposit.

16.32.020 - Use of maintenance deposits.¶
The maintenance deposits may be used at the discretion of the city to maintain traffic control, landscape and/or irrigation improvements to a public right-of-way or to correct deficiencies or conditions on such improvements after completion of construction and prior to acceptance of said improvements by the city. The city shall have the right, but not the duty, to perform said maintenance or to correct such deficiencies or conditions.

16.32.030 - Return of unexpended maintenance deposits.¶
Any unexpected amount of the maintenance deposits shall be returned to the developer at the time all guaranty security for the project is released. No guaranty security shall be released unless all amounts due the city pursuant to Section 16.32.010 have been paid.
