10.04.170 - Permit conditions.

Persons issued a permit pursuant to this chapter must comply with the following:

A. Permittees must comply with all local, state and federal laws regulating alarm systems.

B. Permittees must maintain a valid business license issued pursuant to this code.

C. Permittees must respond, or have an authorized representative respond, to the alarm site within thirty minutes after being notified by the public safety department that an alarm is malfunctioning.

D. Permittees must pay all fees required by this chapter including, without limitation, fees for failing to respond to an alarm site and for false alarms.

E. Permittees must consent to having public safety officers enter onto an alarm site if the permittee, or the permittee's authorized representative, fails to respond to an alarm site as required by this chapter upon being notified by the public safety department.

F. Permittees must maintain at each alarm site a set of written operating instructions for each alarm system.

G. Nothing in this chapter imposes a duty on the city to respond to an alarm.

H. Permittees must enter into a hold harmless agreement with the city which will, in part, indemnify city, its officers, employees, and agents, from any liability arising from permittees' activities in a form approved by the city attorney's office.

I. Permits are not transferable to another person or to another location.

10.04.180 - Effective term of permit—Permittee required to provide notice of changes…

A. Except as provided in subsection B, a permit issued under this chapter will remain in effect unless suspended or revoked by the administrator.

B. A permit will automatically expire unless a permittee timely files a change in application information in accordance with Section 10.04.130 whenever one of the following occurs:

  1. There is a change of ownership at the alarm site;

  2. There is a change of business name or use (as defined in Section 19.04.805) at the alarm site;

  3. The permittee moves the business to a new location;

  4. The alarm system at the alarm site is substantially changed or modified.

10.04.190 - Entry by public safety.

If public safety officers cannot contact the permittee or his or her authorized representative or the permittee fails to confirm a response within thirty minutes, public safety officers may, but are not required to, enter any unsecured building or structure at the alarm site in order to deactivate the alarm and/or secure the alarm site.

10.04.200 - Silent or audible alarm, presumption.

It is presumed that an alarm results in an alarm dispatch request.

10.04.210 - Permittees' joint and several obligations.

The duties imposed by this chapter on permittees are imposed jointly and severally on each person who occupies or who is entitled to occupy an alarm site, regardless of whether such person installed, operated, or knew of the existence of an alarm system at the alarm site.
