1.24.010 - Designated.¶
A. Any person who violates any provisions of this code is guilty of a misdemeanor except as hereinafter provided.
B. Any person who violates any provision of this code is guilty of a separate offense for each day during which such violation occurs or continues.
C. Any person convicted of a misdemeanor under the provisions of this code, unless otherwise provided in this code, shall be punished by a fine of not exceeding one thousand dollars or by imprisonment not exceeding six months or by both such fine and imprisonment. Every violation determined to be an infraction is punishable by (1) a fine not exceeding one hundred dollars for a first violation; (2) a fine not exceeding two hundred dollars for a second violation of the same ordinance within one year; (3) a fine not exceeding five hundred dollars for each additional violation of the same ordinance within one year.
D. When the prosecuting attorney files in the municipal court a complaint or citation specifying that the offense is an infraction or moves to amend a preexisting misdemeanor complaint or citation to specify that the offense is an infraction, the offense shall thereafter for all purpose be treated as an infraction, and subject to the same conditions relating to infractions set forth in the California Penal Code and other provisions of the general laws of California.
