1.04.010 - Definitions.¶
As used in this code, unless a different meaning is apparent from the context or is specified elsewhere in the code, the following words shall have the following meanings:
A. "City" means the area within the territorial city limits of the city of Calexico and such territory outside of this city over which the city has jurisdiction or control by virtue of any constitutional provision or any law.
B. "Council" means the city council of this city.
C. "Oath" includes affirmation.
D. "Person" means a human individual, his or her heirs, executor, administrator or assigns, and means and includes manager, proprietor, copartnership, company, association, municipal corporation, society, firm or corporation, agents, servants, employees, its or their successors or assigns and persons of both sexes.
E. "Section," "article," "chapter" and "division" mean, respectively, section, article, chapter and division of this code.
F. "Writing" includes every form of legible recording.

1.04.020 - Title of office.¶
The use of the title of any officer, employee, office, department, board, commission or ordinance means such officer, employee, office, department, board, commission or ordinance of the city of Calexico, unless otherwise designated.

1.04.030 - Interpretation of language.¶
Words and phrases not defined in this code are construed according to the approved usage of the language.

1.04.040 - Grammatical interpretation.¶
A. Number. Words in the plural number include the singular number, and words in the singular number include the plural.
B. Gender. Any gender includes the other genders.
C. Tense. Words in the present tense include the future.

1.04.050 - General interpretation.¶
The provisions of this code and all proceedings under it are to be construed to effect its object and to promote justice.

1.04.060 - Effect on existing provisions.¶
The provisions of this code, insofar as they are substantially the same as existing provisions relating to the same subject matter, shall be construed as restatements and continuations thereof and not as new enactments.

1.04.070 - Effect of headings.¶
Division, chapter, article and section headings contained in this code shall not govern, limit, modify or affect the scope, meaning or intent of the provisions of this code.

1.04.080 - Territorial limitation.¶
This code shall refer only to the omission or commission of acts within the territorial limits of the city of Calexico and that territory outside of this city over which the city has jurisdiction or control by virtue of the Constitution, or any law, or by reason of ownership or control of property.

1.04.090 - Application to city.¶
All references in this code to places, acts, persons or things and all else in relation to this code shall be construed to mean that the same are applicable to this city, whether the city is mentioned in any particular section or not.

1.04.100 - Licenses and penalties.¶
The adoption of this code shall not be construed as a waiver of any license or penalty due and unpaid under any ordinance at the effective date of the code; nor shall such adoption be construed as affecting any provision of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to the violation thereof.

1.04.110 - Bonds and deposits.¶
The adoption of this code shall not affect the validity of any bond or cash deposit required to be posted, filed or deposited pursuant to any ordinance; and all rights and obligations thereunder shall continue in full force and effect.

1.04.120 - Matters of record.¶
This code shall not affect deposits or other matters of record which refer to, or are otherwise connected with, ordinances which are therein specially designated by number or otherwise and which are included in the code; but such references shall be construed to apply to the corresponding provisions of the code.

1.04.130 - Prior ordinance violations.¶
Prosecution for violation of ordinances committed prior to the effective date of this code shall not be affected by the adoption of the code.

1.04.140 - Severability.¶
If any provision of this code, or the application thereof to any person or circumstances, is held invalid, such invalidity shall not affect other provisions or applications of this code which can be given effect without the invalid provision or application; and, to this end, the provisions of this code are declared to be severable.
