5.37.010 - Prohibited activity.¶
It shall be unlawful for any person, business, partnership or corporation to service, offer to service, or maintain or offer to maintain or allow to be maintained any item, equipment, appliance, system or apparatus defined as "fire protection equipment" under Section 10.302(a) and Section 10.303(b) of the Uniform Fire Code unless such person, business, partnership or corporation shall obtain a business license from the city, and shall hold a certificate of approval from the fire chief of the city of Big Bear Lake as the governing body of the Big Bear Lake Fire Protection District which is a subsidiary district of the city. It shall likewise be unlawful for any person or entity to aid and abet such conduct.

5.37.020 - Issuance.¶
A. An application for such certificate shall include:
The name of such person, business, partnership or corporation and proof of the legal status of any business, partnership or corporation; and
Proof of licensing by the State Fire Marshal; and
Proof of a current city business license; and
Notification of the location of work to be done; and
Proof of bond or current liability insurance to insure against negligent performance of service or maintenance;
Such other information as the fire chief shall request.
B. No certificate shall be issued unless all of the items in subsection A are established within the application.

5.37.030 - Duration of certificate.¶
Any certification issued under this chapter shall expire three hundred sixty-five days from the date of its issue. Recertification shall be in the same manner as the original certification.

5.37.040 - Duties.¶
Any person authorized to perform service under this chapter shall file a written report with the fire chief within two working days of any service or maintenance work performed. Such report shall include, but not be limited to, the owner's name, location of equipment, work performed, and any defects noted in the equipment, appliance or apparatus, date of prior service and the name of such person, business, partnership or corporation performing such prior service.

5.37.050 - Annual inspection required.¶
A. Unless more frequent inspections are required within the Uniform Fire Code, all equipment mentioned in Section 5.37.010 shall be serviced and subjected to maintenance once each year, and proof of such service or maintenance shall be filed with the fire chief.
B. Any inspection, maintenance or service done without a certificate issued to the inspector or person or entity performing such maintenance, service or inspection shall be invalid, and it shall be conclusively presumed that no inspection was performed or service or maintenance done.

5.37.060 - Unserviced equipment prohibited.¶
It shall be unlawful to have situated within the city of Big Bear Lake any device or apparatus defined under Section 5.37.010 which has not been inspected if such device is intended to meet occupancy requirements under the building code or Uniform Fire Code.

5.37.070 - Revocation of certificate.¶
A. Any certificate issued under this chapter shall be revoked for failure of any of the required conditions of Section 5.37.020. Such revocation shall not be subject to an appeal.
B. Any certificate issued under this chapter may be suspended or revoked by the fire chief because of any of the following:
Failure to file reports as required under Section 5.37.040;
A determination after investigation and confrontation hearing before the fire chief that the holder of such certificate has not performed the inspection, service or maintenance or has not performed such service, inspection or maintenance in conformity with the standards of the trade. Any suspension or revocation of a certificate may be appealed to the city council upon the payment of an appeal fee equal to the fee paid for an appeal to the council from a planning commission decision. Pending such appeal, any suspension or revocation ordered by the fire chief shall be stayed. Nothing in this section shall prohibited the fire chief from a subsequent suspension or revocation during the appeal period.

5.37.080 - Penalties.¶
A. A violation of Section 5.37.010 shall be a misdemeanor punishable by imprisonment in the County Jail not to exceed six months or by a fine not to exceed five hundred dollars or by both such fine and imprisonment.
B. Any person aiding and abetting the violation of Section 5.37.010 shall be guilty of a misdemeanor punishable by imprisonment in the County Jail not to exceed thirty days or a fine of two hundred fifty dollars or by both such fine and imprisonment.
C. Any person violating Section 5.37.060 shall be guilty of an infraction punishable by a fine not to exceed one hundred dollars.

5.37.090 - Augmentation of Uniform Fire Code.¶
This chapter shall not supersede any ordinance adopting, amending or referencing the Uniform Fire Code, but shall augment its provisions and be enforceable independently or in conjunction therewith.
