5.04.010 - Landing and takeoff regulations—Exceptions.¶
It is unlawful and an offense for any person to take off in or land any aircraft within the unincorporated area of the city at any point except airports and heliports; provided, that the prohibition of this section shall not apply to mechanical failure or flight operations emergency. The term "emergency" as used herein shall be construed to include sheriff, rescue and ambulance missions and other flights conducted in the public interest, and urgency flight operations of public utility companies occasionally utilizing their own properties or, with prior permission, land owned by others, in accordance with federal and state regulations.

5.04.020 - Violation—Penalty.¶
Any person, association, firm or corporation who violates any of the provisions of this chapter or rules and regulations promulgated hereunder shall be guilty of a misdemeanor, and upon conviction shall be punished by a fine not to exceed five hundred dollars. Each day such violation shall be permitted to exist shall constitute a separate offense.

5.04.030 - Injunctive relief.¶
Any person, association, firm or corporation violating any of the provisions of this chapter may be enjoined by a suit filed by the city in a court of competent jurisdiction, and this remedy shall be in addition to any other penalty provision.

5.04.040 - Applicability of provisions.¶
None of the provisions of this chapter shall be construed to apply to facilities owned or activities conducted by federal, state or municipal governments or agencies thereof.

5.04.050 - Nonliability of city.¶
The city in no event shall be liable for any personal injuries or property damages occasioned in any way in connection with the construction, establishment, maintenance or operation of any airport or heliport.

5.04.060 - Severability.¶
If any provisions of this chapter or the application thereof to any person or circumstances shall be held invalid, such invalidity shall not affect the provisions or application of this chapter which can be given effect without the invalid provision or application, and to this end the provisions of this chapter are declared to be severable.
