16.09.010 - Submittal.

Any person desiring a lot line adjustment between two or more existing parcels, where the land taken from one parcel is added to an adjacent parcel, and where the number of parcels remains the same, shall file an application for a lot line adjustment with the department of community development, accompanied by such information as outlined in the subdivision manual and by a fee established by resolution of the city council.

A. Applications for a lot line adjustment and the review thereof shall conform with such requirements as to form, content and process as specified in the subdivision manual.

B. Applications for lot line adjustments shall be prepared by a registered civil engineer or licensed land surveyor.

C. Existing property lines can be based on a survey of record. The adjusted lot line(s) shall be monumented.

D. Applications for lot line adjustments shall be reviewed by the city engineer, who shall approve or disapprove the proposed lot line adjustment.

16.09.020 - Approval.

A. Within thirty days after an application for approval of a lot line adjustment has been filed, the city engineer, shall approve or conditionally approve or deny the lot line adjustment. The city engineer shall approve or conditionally approve a lot line adjustment if the lot line adjustment does not:

  1. Create or delete any new lots;

  2. Include any lots or parcels created illegally;

  3. Impair any existing access or create a need for access to any adjacent lots or parcels;

  4. Impair any existing easements or create a need for any new easements serving adjacent lots or parcels;

  5. Constitute poor land planning or undesirable lot configurations due to existing environmental conditions or current zoning development standards;

  6. Require substantial alteration of any existing improvements or create a need for any new improvements;

  7. Create a nonconforming lot in the zone to which it exists;

B. The city engineer may impose such conditions of approval, to be satisfied prior to recordation of the lot line adjustment, as the city engineer finds necessary to insure that the boundary adjustments involved are in full compliance with this title.

C. In any case where a lot line adjustment is approved, the department of community development at the city engineer's written request shall file a certificate of compliance with the county recorder's office.

D. Approval or conditional approval of a lot line adjustment by the city engineer shall not become effective until thirty days following receipt of notification of approval or conditional approval from the city engineer.

E. No approved lot line adjustment shall be final until a certificate of lot line adjustment has been recorded with the office of the county recorder.
