16.08.010 - Amendment of filed map—Purpose.

A. After a final map or parcel map is filed in the office of the county recorder, it may be amended by amending map:

  1. To correct an error in any course or distance shown thereon;

  2. To show any course or distance that was omitted therefrom;

  3. To correct an error in the description of the real property shown on the map;

  4. To indicate monuments set after the death, disability or retirement from practice of the engineer or surveyor charged with responsibilities or setting monuments;

  5. The show the proper location or character of any monument which has been changed in location or character originally was shown at the wrong location or incorrectly as to its character;

  6. To correct any other type of map error or omission as approved by the county surveyor or city engineer, which does not affect any property right. Such errors and omissions may include, but are not limited to, lot numbers, acreage, street names, and identification of adjacent record maps. As used in this section, "error" does not include changes in courses or distances from which an error is not ascertainable from the data shown on the final or parcel map.

B. The procedure for revising a tentative or final map before a map is filed is outlined in section 3.7 of the subdivision manual.

16.08.020 - Procedure for amendment.

The amending map shall be prepared and signed by a registered civil engineer or licensed land surveyor. An amended map shall be used only when fewer than ten percent of the total lots in the specific area of the subject subdivision are affected by the changes. An amending map shall conform to the requirements of Chapter 16.04 if a final tract map or Chapter 16.07 if a parcel map. The amending map shall set forth in detail the corrections made and show the names of the present fee owners of the property affected by the correction or omission. The city engineer shall examine the amending map and if the only changes made are those set forth in Section 16.08.010, he shall certify to this fact on the amending map. The city engineer shall maintain an index of recorded amended maps.

16.08.030 - Recordation.

Once the amending map has been certified by the city engineer, it shall be recorded by the city in the office of the recorder of the county of San Bernardino and thereupon, the original map shall be deemed to have been conclusively so corrected.

16.08.040 - Further modifications to approved maps.

In addition to the amendments provided for in Section 16.08.010, final maps and parcel maps may be further modified pursuant to this section. Such modifications shall include realignments of property lines, adjustments to common areas, reduction in lot numbers, or similar changes in circumstances which make any or all of the conditions of such a map no longer appropriate or necessary and that the modifications do not impose any additional burden on the present fee owner of the property, and if the modifications do not alter any right, title, or interest in the real property reflected on the recorded map. This section shall be used in lieu of lot line adjustment procedures when more than ten percent of the lots within the subdivision are affected by the modifications. The procedures for modification of final maps and parcel maps shall be the same as specified by this chapter for tentative tract and parcel maps with the exception that the matters and issues to be considered at the required hearings shall be limited to those matters and issues immediately associated with the proposed modifications and any conditions imposed upon the map shall be limited to those necessary to implement the proposed modifications and to enable the planning commission and/or the city council to make the required findings for approval.

16.08.050 - Fees.

Each request for correction, amendment, or modification to a map shall be filed with the director of community development upon such forms, and accompanied by a fee as adopted by resolution of the city council, and such information as may be prescribed by the director of the department of community development and the city engineer.
