13.04.010 - Adjustment of user charges.

A. The charge for use of sewer services furnished by the Big Bear Lake Sanitation District is fixed at six dollars and ninety cents per month for each equivalent dwelling unit.

B. The minimum charge for sewer service shall be the charge for one equivalent dwelling unit.

C. For each equivalent dwelling unit (EDU) liable for payment of sewer user fees in the city of Big Bear Lake, there shall be levied, collected and paid an annual fee of eleven dollars as a part of each sewer user bill. Such fee shall be in lieu of land use fees.

13.04.020 - Operative date.

The charges fixed by this chapter shall be operative as of the first day of November, 1978.

13.04.030 - Equivalent dwelling unit.

Except as provided in Section 13.04.040, the number of equivalent dwelling units assigned to each user shall be the same as the number of equivalent dwelling units fixed and established for all the various classifications of types and uses of property by the rules and regulations of the sanitation district, as such rules and regulations may be duly revised from time to time.

13.04.040 - Billing and payments.

A. Sewer user fees assessed by the Big Bear Department of Sanitation shall be billed to the users of the service on the last day of each calendar quarter at the rates provided in this chapter. Payments of such fees will be due and payable as of the first day of the calendar quarter following the quarter in which the related service was rendered.

B. Such payments shall become delinquent thirty-one days following the date on which the related billings are issued and a penalty of ten percent of such delinquent billing. An additional ten percent penalty shall be added for each additional month of delinquency. As of July 1st of each year any delinquent amounts will be added to the tax bill for the real property served.

C. The effective date of this amendment shall be July 1, 1981.

13.04.050 - Election of equivalent dwelling unit.

A. A commercial or multiple dwelling unit user may elect to pay sewer service charges based upon an assignment of equivalent dwelling units as defined in Section 13.04.030.

B. The election so made shall be binding upon the user for a period of one year after such election is made, except that a different election may be made by such user whenever the user reimburses the sanitation district for the reasonable costs to the district.

13.04.060 - Amendment of Section 7.1 of district rules.

A. Section 7.1 of the Rules and Regulations of the Big Bear Lake Sanitation District is amended by the addition of the following language:

Whenever, as a result of an inspection of a sewer connection pursuant to this section, the inspector representing the city of Big Bear Lake finds that the connection does not meet city requirements, and by reason thereof orders a correction, there shall be paid, by the person making the faulty connection, a fee of fifteen dollars ($15.00) for any re-inspection of the corrected work made by the city until such time as such connection is found to be in full compliance with the city requirements.

B. The reinspection fee required by subsection A shall be due and payable on notice to the person responsible therefor that the prior connection is faulty and such sum, if not paid, shall be collectible in the same manner as any other debt of the city.

13.04.070 - Amendment of Section 7.7 of district rules.

Section 7.7 of the Rules and Regulations of the Big Bear Lake Sanitation District is amended to read as follows:

SECTION 7.7:

USER CHARGE CLASSIFICATIONS

  1. User Charge Classifications

User charges for all users of the public sewer shall be based on the number of equivalent dwelling units ("EDUs") assigned to such users and the bases for assigning equivalent dwelling units to users within such classifications are as follows:

(a) Residential:

Single family dwelling (residences, apartments and condominiums)—1 EDU per living unit.

Motels—1 EDU per 3 separate overnight units.

Mobile home parks—1 EDU for club house plus 3 additional EDUs per 4 mobile home spaces.

Rooming houses—1 EDU per 3 occupants.

(b) Commercial:

Churches

With kitchens—2 EDUs.

Without kitchens—1 EDU.

Conference centers—1 EDU per 3 overnight rooms.

Conference centers with restaurant or bar—as above plus 1 additional EDU per 10 customer seats in restaurant and 2 EDUs for bar.

Golf courses—1 EDU plus 1 additional EDU per 20 plumbing fixture units in excess of 20. Additional units for restaurant, if any, shall be assigned as hereinafter provided.

Hospitals—1 EDU per 2 bed spaces.

Laundries—1 EDU per 750 pounds of dry washing per day.

Laundromats—1 EDU per automatic washer.

Meeting halls

With kitchen—2 EDUs.

Without kitchens—1 EDU.

Recreational trailer parks—1 EDU plus 1 EDU per 2 trailer spaces.

Restaurants

With bar—1 EDU per 10 customer seats plus 2 EDUs for bar.

Without bar—1 EDU per 10 customer seats.

Schools—1 EDU per 25 occupants (students administrators, teachers and employees).

Taverns—3 EDUs.

(c) Commercial—General:

For commercial establishments not specified in subparagraph (b) above EDUs shall be assigned on the basis of 1 EDU per 20 plumbing fixture units.

(d) Special Case:

Commercial and other establishments, whether specified above or not, which discharge into the public sewers an unusually high volume of domestic sewage shall be assigned EDUs in accordance with the following formula:

Design flow - 200 gallons per day (gpd) = EDUs rounded to next highest whole number.

Unusual strength sewage shall be assigned EDU in accordance with the following formula:

  1. Users Contesting Classification

Users who are placed within a classification pursuant to Part 14.1 and who are dissatisfied with such classification may, by requesting that flows of sewage and wastewater from their establishments be metered and sampled, have equivalent dwelling units assigned to them on the basis of the formula set forth in subparagraph (d) of said part. Said users shall pay the cost of installing meters and the cost of all monitoring, testing and sampling of flows of sewage and wastewater from their establishments.

13.04.080 - Amendment of Section 1.5.05 of district rules.

Section 1.5.05 of the Rules and Regulations shall be amended to read as follows:

1.5.05—Contractor—An individual, firm, corporation, partnership, or association duly licensed by the State of California as a Class A or "C-42" licensee to perform the type of work to be done under the permit, contract or agreement.

13.04.090 - Amendment of Section 4.4 of district rules.

Section 4.4 of the Rules and Regulations shall be amended to read:

Application for connection to the sewers—An applicant shall make application for connection to the sewer system at the department office. The permit issued upon application shall be issued only to a licensed, bonded contractor as defined in Section 1.5.05 of this ordinance. Applicant shall give a description of the character of the work proposed to be done, the legal description lot, tract, parcel number, and sites address, the location, ownership, occupancy, and use of the premises to be served, and the name and address of the person who shall make the connection. The department may require plans, specifications, or drawings and such other information as may be deemed necessary to insure compliance with the department's rules and regulations.
