10.28.010 - Prohibited activities—Penalties.

A. It is unlawful for any person to ski, tube, toboggan, sled, or slide upon any public street, sidewalk, alley, right-of-way, or public parking lot within the city.

B. It is unlawful to allow, encourage, aid, or assist any child under the age of sixteen to ski, tube, toboggan, sled, or slide upon any public street, sidewalk, alley, right-of-way, or public parking lot within the city.

C. It is unlawful to use any property abutting a public highway, street, or sidewalk, or to use a public highway, street, or sidewalk for snow play activities such as skiing, tubing, tobogganing, sledding or sliding, in a manner that causes several persons to gather, thereby directly or indirectly obstructing traffic and the free use of public highways, streets and sidewalks.

D. A violation of subsection A of this section shall be an infraction, and each occasion that a violation shall occur shall be a separate and distinct offense. A first conviction shall be punishable by a fine not to exceed fifty dollars. Any second offense within a twenty-four-month period shall be subject to a fine not to exceed one hundred dollars, and third offense shall be a misdemeanor punishable by jail, fine, or both, as prescribed by the Penal Code.

E. A violation of subsection B of this section shall be a misdemeanor, punishable by jail or fine, as prescribed by the Penal Code.

F. A violation of subsection C. of this section is a public nuisance for the purposes of Municipal Code Title 8, Chapter 8.80, "Public Nuisances," and an action for injunctive relief may be commenced for the abatement, removal and enjoinment thereof in the manner provided by law. In addition, a violation of subsection C. of this section may be subject to the enforcement and remedy provisions of Municipal Code Title 1, Chapter 1.16, "General Penalty" and Chapter 1.17, "Administrative Citations and Hearings." All remedies prescribed hereunder shall be cumulative and the use of one or more remedies by the City shall not bar the use of any other remedy for the purpose of enforcing the provisions of subsection C. of this Section.
