5-6-1302: DRINKING IN PUBLIC PLACES:

No person shall consume any beer, wine, or other intoxicating beverage on any public street, greenbelt, median island, parking lot, alley, sidewalk, or other public place, except at such times and in such areas designated or permitted by the city for such use. No person shall consume any beer, wine, or other intoxicating beverage on any private parking lot, walk, wall, stairway, driveway or other property open and accessible to the public without the permission of the owner, occupant or person in control of such private property. 5-6-1303: SITTING OR LYING ON PUBLIC WAYS:

No person shall sit, lie or sleep in or upon any public street, greenbelt, median island, parking lot, alley, sidewalk, or other public place or way open for pedestrian or vehicular travel. The provisions of this section shall not prohibit a person from sitting upon a public street, greenbelt, median island, parking lot, alley, sidewalk, or other public place if:

A. Necessitated by the physical disability of such person; or

B. Such person is viewing a legally conducted parade; or

C. Such person is seated on a bench lawfully installed for such purpose. (Ord. 93-O-2165, eff. 4-23-1993)

5-6-1304: LEAVING PERSONAL PROPERTY ON PUBLIC WAYS:

No person shall leave or permit to remain on any public street, greenbelt, median island, parking lot, alley, sidewalk, or other public place or way open for pedestrian or vehicular travel any merchandise, baggage or other article of personal property except as permitted by the city. 5-6-1305: SLEEPING DRAGONS AND OTHER SIMILAR DEVICES:

No person shall carry or possess while on any public street, greenbelt, median island, parking lot, alley, sidewalk, or other public place or way open for pedestrian or vehicular travel any sleeping dragon device with the intent to use the sleeping dragon device to deny or obstruct the public's ability to freely move about on roadways, sidewalks, or into or out of buildings. For the purposes of this section, a "sleeping dragon device" shall mean a section of pipe, or a container, filled with weighted materials, handcuffs, chains, or other locking devices utilized for the purpose of locking a person or persons to other persons or other objects. 5-6-1306: TRESPASS ON GROUNDS OF PUBLIC SCHOOL:

It shall be unlawful for any person to enter the grounds, including, but not limited to, any street, sidewalk, pedestrian walkway, playground or parking area therein, or any property or buildings of a public school or remain on such grounds or property in violation of posted rules. Any such conduct shall constitute a trespass upon school property. (Ord. 03-O-2428, eff. 9-26-2003)

5-6-1307: HUMAN WASTE:

No person shall urinate or defecate on public property except in a facility intended for accepting human waste located in a public restroom. (Ord. 07-O-2538, eff. 12-21-2007)

5-6-1308: ACCESS TO CITY OWNED AND PARKING AUTHORITY OWNED PARKING STRUCTURES:

A. No person may be present in a city owned parking structure or parking authority owned parking structure unless he or she is engaged in one of the following activities or accompanying someone who is so engaged:

  1. Parking or unparking a vehicle or riding in a vehicle that is being parked or unparked.

  2. Departing from or returning to a vehicle that is parked in the parking structure.

  3. Using or going to or from a public restroom located in the parking structure.

  4. Operating or maintaining the parking structure as an employee or contractor of the city.

All activity, other than the activity listed above, is prohibited in a city owned parking structure or parking authority owned parking structure, including but not limited to, riding any bicycle, skateboard, roller skates, scooters or similar type of device, engaging or participating in any type of game or sport, including but not limited to, baseball, football, or similar activity, or throwing of balls or other objects.

B. All parking in city owned parking structures or parking authority owned parking structures must be in accordance with posted signs regarding time of day and period of time. All overnight parking is prohibited in such parking structures. Vehicles parked in violation of this Code are subject to removal in accordance with the California Vehicle Code.

C. The term "city owned parking structure" and “parking authority owned parking structure” means the following structures, excepting retail or commercial space:

    1. Beverly North, located at 345 N. Beverly Drive, Beverly Hills.
    1. Beverly South, located at 216 S. Beverly Drive, Beverly Hills.
    1. Beverly-Canon, located at 439 N. Beverly Drive and 438 N. Canon Drive, Beverly Hills.
    1. Brighton, located at 9510 Brighton Way, Beverly Hills.
    1. Camden, located at 440 N. Camden Drive, Beverly Hills.
    1. Bedford, located at 461 N. Bedford Drive, Beverly Hills.
    1. Rexford, located at 450 N. Rexford Drive, Beverly Hills.
  1. Beverly Cañon Gardens, located at 241 N. Cañon Drive, Beverly Hills and 240 N. Beverly Drive, Beverly Hills.

  2. La Cienega, located at 321 S. La Cienega Boulevard, Beverly Hills.

  3. Crescent North, located at 333 N. Crescent Drive, Beverly Hills and 9361 Dayton Way, Beverly Hills.

    1. Crescent South, located at 221 N. Crescent Drive, Beverly Hills.
    1. SM-1, located at 485 N. Beverly Drive, Beverly Hills.
    1. SM-2, located at 485 N. Rodeo Drive, Beverly Hills.
    1. SM-3, located at 485 N. Camden Drive, Beverly Hills.
    1. SM-4, located at 485 N. Bedford Drive, Beverly Hills.
    1. SM-5, located at 485 N. Roxbury Drive, Beverly Hills.

5-6-1309: OCCUPANCY OF PUBLIC RESTROOM:

No person shall occupy a city owned public restroom more than twenty (20) minutes per hour, and no person shall occupy a city owned public restroom at any time such facility has been closed to the public. This provision shall not apply to persons maintaining a city owned public restroom as an employee or contractor of the city. (Ord. 07-O-2538, eff. 12-21-2007)

5-6-1310: BATHING IN PUBLIC FOUNTAIN OR PUBLIC RESTROOM:

No person shall bathe, wash or make other contact with the water in a public fountain, other than a drinking fountain. No person shall use any city owned public restroom to wash any portion of their body other than their arms, neck and face. (Ord. 07-O-2538, eff. 12-21-2007)

5-6-1311: POSSESSION AND USE OF SHAVING CREAM AND OTHER PROHIBITED PRODUCTS ON HALLOWEEN:

A. For purposes of this section:

  1. "Aerosol String," commonly referred to as "Silly String," "Crazy Streamer," "Crazy String," or "Party String," shall mean any putty-like substance that is shot or expelled in the form of string from an aerosol can or other pressurized device, regardless of whether it is sold under the name "Silly String" or any other name.

  2. "Shaving Cream" shall mean the cream, gel or foam that is commonly spread over the face or other parts of the body, for the purpose of, or preparation for, shaving.

  3. "Hair Removal Product," shall mean the cream, lotion, or gel that is commonly spread over the surface of the skin for the purpose of hair removal, regardless of whether it is sold under the name "Nair" or any other name.

  4. "Halloween" shall mean the twenty-four (24) hour period from 6:00 a.m. on October 31st of each year, through 6:00 a.m. November 1st of each year.

B. On Halloween, no person under the age of twenty one (21) shall possess or use Aerosol String, Shaving Cream or Hair Removal Product, within or upon any street, including any greenbelt, median island, alley, parkway, sidewalk, or other public property, including a public parking lot. Additionally, on Halloween, no person under the age of twenty one (21) shall possess or use Aerosol String, Shaving Cream or Hair Removal Cream, within or upon any private parking lot, walk, wall, stairway, driveway or other property open and accessible to the public without the permission of the owner, occupant or person in control of such private property.

C. This provision shall not apply to persons transporting a single container of Aerosol String, Shaving Cream or Hair Removal Product directly to their residence from a business licensed under Classification B or Classification C as defined in Municipal Code Section 3-1-219 .
