5-3-1: COUNTY PUBLIC HEALTH CODE AND PUBLIC HEALTH LICENSING REGULATIONS ADOPTED:

Regulations governing public health matters in the city are those prescribed in division 1 of title 11 (the county health code) and division 1 of title 8 (public health licenses) of the Los Angeles County code, as the same have been amended and are in effect as of May 1, 2000, and the same are hereby adopted by reference and made part of this chapter, subject to such amendments and additions as set forth herein. A certified copy of division 1 of title 11 and division 1 of title 8 shall be maintained on file in the office of the city clerk for use and inspection by the public. (1962 Code § 5-4.01; amd. 5-3-2: INTERPRETATION AND ADMINISTRATION:

The following rules shall govern the interpretation and administration of the health code and public health licensing regulations adopted in this chapter:

A. Whenever the word "county" or any abbreviation thereof appears in said health code or regulations, it shall be interpreted and deemed to mean the word "city".

B. Whenever the words "Los Angeles" or any abbreviation thereof appear in said health code or regulations, they shall be interpreted and deemed to mean the words "Beverly Hills".

C. Whenever there is a conflict between any of the provisions of the health code and/or regulations, and other sections of this code or laws of the city relating specifically to the same subject matter, the latter shall prevail.

D. The definition or regulation of any activity, condition, or structure in the health code or regulations shall not be interpreted or deemed to permit or allow the conduct of any such activity or the construction or maintenance of any such condition or structure as may be otherwise prohibited or restricted by any other section of this code or other laws of the city heretofore or hereafter adopted. 5-3-3: DIVISION 1, TITLE 8, AMENDED:

Notwithstanding the provisions of section 5-3-1 of this chapter, section 8.04.339 of chapter 8.04 of division 1 of title 8 of the Los Angeles County code is hereby amended to read as follows:

Section 8.04.339. Owner Initiated Inspection.

"Owner initiated inspection" means an inspection of a food facility that is conducted no more than once in any twelve (12) month period by the county health officer at the request of a food facility's owner to provide the food facility the opportunity to improve the letter grade or numerical score issued by the county health officer pursuant to the provisions of this chapter. Each owner initiated inspection shall be conducted in compliance with all applicable enforcement policies and Advisory Bulletins of the Department of Health Services."
