4-2-101: PERMIT REQUIRED:

No person shall engage in, conduct, or carry on any amusement activity or devices without a permit issued under the provisions of chapter 1, article 1 of this title. (1962 Code § 6-3.101 et seq.)

4-2-102: DEFINITIONS:

AMUSEMENT ACTIVITY: The conduct of any business or operation for the purpose of providing recreational or amusement facilities to its users or patrons, including, but not limited to, bowling alleys, skating rinks, and shooting galleries; and shall not include any motion picture theater, carnival, circus, or nightclub show.

AMUSEMENT DEVICE: Any electrically or mechanically operated instrument, machine, or piece of equipment activated, operated, or played by coins or tokens or any other similar device not otherwise prohibited by the provisions of title 5, chapter 6, article 4 of this Code. 4-2-103: RESTRICTIONS AND REGULATIONS:

A. Bowling alleys shall remain closed between the hours from twelve o'clock (12:00) midnight to seven o'clock (7:00) A.M., unless enclosed in a soundproof building in which case such business may remain open until two o'clock (2:00) A.M.

B. Nothing in this article shall authorize or permit the maintenance or operation of any gambling device or mechanism that has been judicially determined to be a gambling device, nor any betting or gambling, or other activity or device prohibited by title 5, chapter 6, article 4 of this Code. 4-2-104: INSURANCE:

Any skating rink, shooting gallery, or merry-go-round, or similar mechanical device or an amusement activity, shall maintain at all times public liability insurance in an amount not less than one million dollars ($1,000,000.00). The insurance shall comply with the provisions of title 3, chapter 4 of this Code. (1962 Code § 6-3.101 et seq.)
