Chapter 10.48 — RESTRICTED USE OF STREETS

Sec. 10.48.020. - Truck routes.¶
(a)
Whenever any city resolution designates and describes any street or portion thereof as a street the use of which is permitted by any vehicle exceeding a maximum gross weight limit of three tons, the city engineer is authorized to designate such streets by appropriate signs as truck routes for the movement of vehicles exceeding a maximum gross weight limit of three tons.
(b)
When any such truck routes are established and designated by appropriate signs, the operator of any vehicle exceeding a maximum gross weight limit of three tons shall drive on such routes and none other, except that nothing in this section shall prohibit the operator of any vehicle exceeding a maximum gross weight of three tons coming from a truck route having ingress and egress by direct route to and from restricted streets when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon such restricted streets for which a building permit has previously been obtained.
(c)
This section shall not apply to:
(1)
Passenger buses under the jurisdiction of the public utilities commission;
(2)
Any vehicle owned by a public utility while necessarily in use in the construction, installation or repair of any public utility; or
(3)
Any bus or coach operating under franchise granted by the city council.
(d)
Those streets and parts of streets established by resolution of the council are declared to be truck routes for the movement of vehicles exceeding a maximum gross weight of three tons.

Sec. 10.48.030. - Commercial vehicles prohibited from using certain streets.¶
(a)
Whenever any city resolution designates and describes any street or portion thereof as a street the use of which is prohibited by any commercial vehicle, the city engineer shall erect and maintain appropriate signs on those streets affected by the resolution.
(b)
Those streets and parts of streets established by resolution of the council are declared to be streets, the use of which is prohibited by any commercial vehicle. The provisions of this section shall not apply to passenger buses under the jurisdiction of the public utilities commission or pursuant to a franchise or certificate of convenience and necessity issued by the city council.

Sec. 10.48.040. - Transportation permit.¶
(a)
No person shall operate or move a vehicle or combination of vehicles or special mobile equipment of a size or weight of vehicle or load exceeding the maximum specified in the State Vehicle Code on any highway or street without first obtaining a transportation permit from the city engineer.
(b)
The type of permit may be single trip, annual, repetitive or direct crossing.
(c)
The city engineer is authorized to issue or withhold any permit at his discretion. If the permit is issued, he is authorized to limit the number of trips or to establish seasonal or time and day limitations or designate certain routes within, which the vehicles described may be operated on the highways and streets indicated or otherwise to limit or prescribe conditions of operation of vehicle, when necessary to ensure against undue damage to the road foundations, surfaces or structures and may require the undertaking of other security as may be deemed necessary to protect the highways, streets and bridges from injury or to provide indemnity for any injury resulting from the operation of the vehicle.
(d)
It is unlawful for any person to violate any of the terms or conditions of the special permit.
(e)
The permit application fees shall be the same as those currently in use by the state department of transportation. Additional services necessitated by unusually large or heavy loads, such as engineering investigations, police escorts, tree trimming or other services, shall be billed separately for each permit.
(f)
Nothing in this section shall relieve the operator or driver from any obligation imposed by federal state or local laws relating to this type of transportation.
