2.68.010 - Adoption of personnel system.

In order to establish an equitable and uniform procedure for dealing with personnel matters; to attract to municipal service the best and most competent persons available; to assure that appointments and promotions of employees will be based on merit and fitness as determined by competitive test; and to provide a reasonable degree of security for qualified employees, the following personnel system is hereby adopted.

2.68.020 - Applicability of chapter to all city officers and employees—Exceptions.

The provisions of this chapter shall apply to all offices, positions and employments in the service of the city except:

A. Elective offices; however, in the event the people of the city by election change the status of any of the elective offices of the city to that of appointive offices, then at the expiration of his or her term of office, the city manager shall appoint a successor to the office in accordance with established personnel rules. (Government Code Section 34856) which rules shall thereafter be applicable to such appointee.

B. Positions on appointive boards, commissions and committees.

C. Persons under contract to supply expert, professional or technical services.

D. Volunteer personnel who receive no regular compensation from the city, except reserve police officers or volunteer firefighters.

E. City manager; city attorney; chief of police; city engineer; director of finance; secretary to the city manager, street superintendent, city electrician; human resource director, and any certified professional personnel.

2.68.030 - Personnel rules generally.

General policies for the administration of personnel shall be adopted and may be amended from time to time by resolution of the city council. Such policies may be implemented through administrative procedures promulgated by the city manager.

2.68.040 - Authority to issue subpoenas in personnel matters.

All administrative procedures relating to the city's personnel system shall include the power of issuing and enforcing legislative subpoenas for purposes of compelling the attendance of witnesses and/or the production of other evidence as authorized by Municipal Code Chapter 1.30. The power to subpoena witnesses and evidence pursuant to chapter 1.30 shall apply to all personnel proceedings regardless of whether such proceedings are established by a city ordinance, resolution, contract or collective bargaining agreement adopted by the city council.
