2.44.010 - Establishment.¶
The city council of the City of Banning does hereby establish a public works advisory committee with the powers and duties hereinafter set forth.

2.44.020 - Powers and duties.¶
The public works advisory committee shall serve as an advisory agency to the city council and the public works director for the purpose of the formulation of rules, regulations and policies for all public works department programs and activities. As appropriate, the committee shall recommend to the city council rates and fees for water, electric and wastewater revenue producing utilities owned, controlled or operated by the city. Also, the committee shall review CATV rates, fees and policies which are subject to approval by the city council pursuant to the CATV franchise agreement and other policies and regulations of the city. The committee shall also operate as the airport advisory committee for the City of Banning.

2.44.030 - Appointment of members.¶
A. Each appointment to the public works advisory committee shall be by a city councilperson to a term to run concurrent with the term of the appointing councilperson. Each councilperson shall have one appointee to the board.
B. Review of the appointments to the committee shall take place at the city council's first meeting in January of each year. After the effective date of the ordinance codified in this chapter all incumbent committee members and all subsequently appointed committee members shall continue to be seated and exercise the authority of a committee member until the date of appointment of the successor committee member or until removed pursuant to this section.
C. A committee member may be removed at any time either by the city councilperson making the appointment or by the vote of four members of the city council.
D. No person shall be eligible for appointment to the committee unless he or she is a resident of the City of Banning. He or she shall also be a registered voter of the City of Banning. Should a person so appointed move his or her place of residence outside the city, his or her office shall immediately become vacant. Committee members shall not at the same time be a committee member on any other board or committee of the city.
E. In the event of a vacancy on the public works advisory committee the councilmember who made the original appointment to the vacant seat shall appoint a new committee member subject to the provisions of this section.
F. All committee members must complete the standard application which shall be submitted to the city clerk to duplicate and forward to all city councilmembers prior to any appointment. All reasonable sources, including newspapers and cable TV, shall be used to solicit applicants.

2.44.040 - Conduct of meetings; Vacancy.¶
A. The committee shall meet quarterly during the months of January, April, July, and October on the third Monday of each month at 6:30 P.M. at City Hall. If said day is a holiday, the committee shall meet on the following Monday. Additional meetings may occur if deemed necessary by the city council, city manager, or public works director.
B. A majority of the voting members of the committee shall constitute a quorum.
C. During the regular meeting held in February of each year, the committee shall elect a chairperson and vice-chairperson to serve during the ensuing year.
D. The committee shall adopt such rules and regulations to govern their operations as they deem necessary. All such rules and regulations shall, prior to the effective date thereof, be placed on the agenda of the city council for its review and approval.
