2.60.010 - Application.

Requests for use of city administrative buildings, council chamber, and meeting rooms (excluding parks and recreation facilities) shall be submitted in writing to the city clerk's office at least fifteen working days prior to the date of the event. This requirement may be waived by the city clerk on a showing that the application could not reasonably be submitted within such time. Regarding cancellations, the city clerk's office must be notified at least seventy-two hours before the event date, so that the room(s) may be reassigned.

2.60.020 - Conditions of use.

Use of facilities by the defined groups listed in the section which follows herein shall be subject to the provisions of this chapter when such conditions of use as appear reasonable and prudent for the preservation and protection of public property, which includes proof of liability and property insurance or demonstration of other forms of financial responsibility.

2.60.030 - Definition and priority of groups.

The use of city administrative buildings, council chambers, and meeting rooms (excluding parks and recreation facilities) of the City of Banning, City Hall, is restricted to governmental agencies, i.e., city, county, state, federal, and related agencies (i.e., school districts), for purposes related to government administration. Groups wishing to use city administrative buildings, council chamber, and meeting rooms (excluding parks and recreation facilities) shall be prioritized on the following basis:

A. First Priority Group. Reserved for city council meetings and other city council functions;

B. Second Priority Group. Reserved for meetings of city boards, commissions, and committees;

C. Third Priority Group. Includes city departments on an as-needed basis for meetings, training sessions, testing, etc. Also included in this category are events which are sponsored by the city;

D. Fourth Priority Group. Includes all federal, state, regional, county, city (except Banning) governmental and related agencies (i.e., school districts) using city administrative buildings, council chambers, and meeting rooms (excluding parks and recreation facilities) to provide programs or workshops, etc., for the benefit of the city or the community;

E. Fourth Priority Group. Includes community based nonprofit organizations such as service clubs, chambers of commerce, and citizen committees.

The city clerk's office shall notify the applicant as to the use and conditions of use within a reasonable time frame before the event. All others will be referred to the community services department to apply for use of park and recreation facilities.

2.60.040 - Denying application.

City-owned administrative buildings, council chambers, and meeting rooms (excluding parks and recreation facilities) shall not be used by anyone for the purpose of solicitation, selling or any purpose not related to governmental administration.

2.60.050 - Charges.

There will be no room charge for defined priority groups wishing to use city administrative buildings, council chambers, and meeting rooms (excluding parks and recreation facilities).

2.60.060 - Authority of city manager or other official.

A. The city manager, or any officer or employee designated by him or law to maintain order in any building or facility owned or leased by the city, may notify a person, except any officer or employee of a governmental agency on official business, that consent to remain in such building or facility has been withdrawn whenever there is reasonable cause to believe that such person has wilfully disrupted conduct of activities of such building or facility and may direct such person to leave the building or facility.

B. Any person who has been directed to leave a city building or facility pursuant to subsection A above and who thereafter fails to immediately leave such building or facility or who wilfully and knowingly re-enters such building or facility within seventy-two hours after being directed to leave, is guilty of a misdemeanor.

2.60.070 - Remaining in municipal building when building closed a misdemeanor.

A. Any person, other than an authorized public officer or employee acting within the course and scope of his or her employment, who enters or remains in any municipal building or facility with the knowledge that such building or facility is closed to the public and, who does not have the present consent of an official of the city for his or her presence in the building or facility, is guilty of a misdemeanor or an infraction.

B. For the purposes of this section, City Hall, City of Banning, shall be open to the public for the transaction of business between the hours of 8:00 A.M. and 5:00 P.M. daily, except on Saturdays, Sundays and those city holidays designated by the city council.

C. Notwithstanding the foregoing provisions of this section, regular meeting rooms of the city hall may be considered as open to the public during such times as regularly or specially called or scheduled meetings of the city council and city boards, commissions and committees are called or held; provided, however, that only that portion of the city hall shall be considered as open as is designated by the city as necessary to provide reasonable ingress and egress to the open and public meeting facilities; and all other portions of the city hall shall remain and be considered as closed; provided, further, that the meeting facilities and access thereto and therefrom shall be considered as closed after the expiration of one-half hour from the time of the adjournment or termination of the meeting.

2.60.080 - Rules and procedures for use of nonpark public facilities.

The rules and procedures applicable to permitting the use of nonpark public facilities of the city by private parties, commercial groups or nonprofit groups shall be as set forth in Chapter 12.36 of this Code.
