Sec. 18-1101. - Required.

Section 62-161 of this Code shall not apply to any bench, seat, chair or similar device located in or upon any sidewalk, for the accommodation of passersby or persons awaiting transportation, provided a permit is procured as set forth in this division.

Sec. 18-1102. - Application.

Each application for a permit under this division shall be made, considered and granted by the council, and each application shall contain the following:

(1) A statement that the applicant is the owner of each bench for which application is thus made.

(2) The proposed location of each bench.

(3) The number of benches for which permits are held by the applicant at the time of making such application and the respective numbers of such permits.

(4) A description of each bench for which application is thus made, showing its type, dimensions and materials of construction.

(5) One of the following:

a. A signed statement of the owner or person in lawful possession or control of any improved property abutting upon the street at the place where each such bench is proposed to be located, giving his consent to the installation and maintenance of such bench;

b. A statement that such a signed statement has been requested by the applicant from such owner or occupant and has been refused by such owner or occupant; or

c. A statement that such abutting property is unimproved.

(6) A description or statement indicating the nature of the advertising, if any, to appear thereon and the area upon such bench where such advertising is to appear.

(7) A statement by the applicant that, if granted a permit, he will observe, abide by, and be bound by each of the provisions of this article, and each condition upon which the permit is approved by the council.

Sec. 18-1103. - Contents.

Upon compliance with subsection 18-1071(b) by the person applying for a permit required under this division, the business license officer shall issue the permit approved by the council, which permit shall contain the date of its issuance, date of its expiration, the name and address of the permittee, the location of the benches, a number assigned to each bench covered by the permit and a statement of the conditions, if any, upon which the permit was approved. The business license officer shall keep an index of all permits issued under this division and of the bench numbers assigned under each permit. During all times that a bench is maintained in a street under this article, the number assigned by the business license officer to each such bench shall be plainly stenciled thereon by the permittee in numerals at least one inch in height and three-quarters of an inch in width, in waterproof paint of a color to be plainly legible at least five feet therefrom.

Sec. 18-1104. - Cancellation; hearing.

Every permit issued pursuant to this division shall expire and be of no further effect at the end of the fiscal year of the city, June 30 of each year. Any permit issued under this division may, after notice given to the permittee of the time and place of consideration and after hearing before the council, with or without cause, be cancelled and terminated. Notice of such hearing shall be given by mailing to the permittee at his last known address, as appears in the records of the city, postage prepaid, notice of the time and place of the hearing before the council on the revocation of such permit. If, after the hearing, the permit is cancelled, the fees for that year shall be prorated to the date of cancellation and returned to the permittee.
