Azusa Municipal Code Div. 2 Permit

No person shall operate, conduct or hold any auction sale, closing out sale, going out of business sale, bankrupt stock sale, creditor's sale, forced sale, insolvency sale, receiver's sale, insurance sale, removal sale or sale of goods damaged by fire, smoke, water or otherwise, unless there shall have been issued and shall be in effect a permit from the city council to do so as provided in this division and unless all provisions and conditions of such permit are complied with.

Application for any permit required by this division shall be filed with the business license officer in writing, shall be signed and verified by the applicant and shall set forth the following:

(1) The name and address of the applicant.

(2) The location of the proposed sale.

(3) The nature of the occupancy at such location.

(4) The nature of and reason for the proposed sale.

(5) The dates upon or period during which the proposed sale is to be conducted.

The city council may, after such investigation as it deems necessary, grant or refuse to grant a permit required by this division. The city council shall refuse to grant any such permit if it shall determine that the granting of the permit or the conduct of the proposed sale would be contrary to the preservation of the public peace, health, safety, morals or welfare of the city or its inhabitants. If such permit is granted, the city council may impose such terms, conditions and restrictions upon the operation and conduct of the sale, not in conflict with any paramount law, as it may deem necessary or expedient to protect the public peace, health, safety, morals or welfare of the city or its inhabitants.

Any permit issued pursuant to this division shall authorize the conducting of the respective sales therein permitted upon the days or during the period mentioned in the application.
