Article 41 — Development Standards for Churches and Places of Religious Worship

§ 9-2.4101. Standards. ¶
The following development standards shall apply for new churches, temples, synagogues, chapels and other places used for religious worship:
(a) Minimum Lot Size and Spacing Requirements:
(1) A minimum lot area of 40,000 square feet.
(2) For a church or place of religious worship, no such use shall be located within 300 feet of any other property used for a church or a place of religious services.
(b) Setbacks.
(1) In residential zones, the front yard setback shall be at least 20 feet in depth and the rear yard setback shall be at least 25 feet in depth.
(2) In residential zones, the side yard setback shall be at least 10 feet in width.
(3) In the Commercial Service Professional (CSP) Zone, the front and rear yard setbacks shall be at least 10 feet in depth.
(4) Required front and rear yard setbacks shall be landscaped, except that driveways and passenger loading areas may be allowed in such setbacks.
(c) Parking Lot Facilities.
(1) The minimum required number of parking spaces shall be provided as required in Article 11.
(2) Adequate landscaping and buffering shall be provided between parking areas and residential uses.
(3) A six foot high perimeter masonry wall shall be required adjacent to residential uses.
Walls adjacent to commercial or industrial uses shall be required at the discretion of the Planning Commission.
(d) No school, day nursery, kindergarten, or any congregation or persons for purposes other than religious instruction, worship, or guidance shall be permitted on the project site without a separate conditional use permit.
(e) Signs Permitted. Signs permitted shall be as set forth in the development standards applicable to the zone in which the religious use is located.
