§ 2.41.010 HISTORIC PRESERVATION COMMISSION CREATED.

There is hereby created and established a commission which shall be known as the Alhambra Historic Preservation Commission.

§ 2.41.020 PURPOSE OF COMMISSION.

The Commission shall advise the City Council on the draft historic context statement once it is completed, and then subsequently on the draft historic resource survey, and then the drafting of a historic preservation ordinance intended to achieve State of California Office of Historic Preservation Certified Local Government Program (CLG) status. Once the ordinance is prepared and adopted by the City Council, the Commission shall undertake such duties as are described in that historic preservation ordinance.

§ 2.41.030 COMPOSITION, APPOINTMENT AND TERM OF OFFICE, QUALIFICATIONS.

(A) Composition. The Alhambra Historic Preservation Commission shall consist of five members. Members of the Commission shall serve without compensation.

(B) Appointment, term of office. Each member of the City Council shall appoint one member of the Commission, whose terms shall expire at the second regular meeting of the Alhambra City Council in March of 2023. At that same meeting, and annually thereafter, each member of the City Council, shall appoint one member of the Commission, whose term will end at the second regular City Council meeting of the following March. No person appointed to the Commission shall serve more than eight consecutive yearly terms.

(C) Qualifications. All voting members of the Commission shall be at least 18 years of age and a resident of the city. Voting members of the Commission shall also comply with the following qualification requirements:

(1) Commissioners shall have demonstrated special interests, competence, experience, or knowledge in historic preservation.

(2) At least two members of the Commission shall be appointed from among qualified professionals in the disciplines of archaeology, architectural history, architecture, historic preservation, history, landscape architecture, planning, or a related discipline, to the extent that such professionals are available in the community.

§ 2.41.040 EX OFFICIO MEMBERS.

The City Manager, City Attorney, and Director of Community Development, or their designees, shall be ex officio nonvoting members of the Alhambra Historic Preservation Commission.

§ 2.41.050 VACANCIES.

When a vacancy occurs due to removal, resignation or other cause, such vacancy shall be filled for the unexpired term by an appointment made pursuant to § 2.41.030(B).

§ 2.41.060 OFFICERS.

At the first meeting of the Commission after each annual appointment, the Commission shall organize by selecting one member to be president and one member to be vice president. A vacancy in any such office may be filled at any time during such year by action of the remaining members of the Commission.

§ 2.41.070 RECORDS.

The Commission shall maintain minutes of its meetings and shall keep full and complete records of its actions and decisions on all matters before it. The City Manager shall make available one city employee, who shall attend all Commission meetings, shall keep a record of all its proceedings and transactions, and shall perform such other secretarial duties as may be required for the functioning of the Commission.

§ 2.41.080 MEETINGS, OPEN TO THE PUBLIC, RULES AND REGULATIONS, TIE VOTE, QUORUM.

(A) Meetings, record, open to the public. Meetings of the Commission shall be held on an as-needed basis, until otherwise provided for in the city's historic preservation ordinance (once adopted), and shall be subject to the requirements of the California Brown Act. All such meetings shall be open to the public.

(B) Rules and regulations. Except as hereinafter provided in division (D) or otherwise provided by City Council ordinance or resolution, the Commission shall make and enforce its own rules and regulations with respect to its meetings.

(C) Quorum. A majority of the voting members of the Commission shall constitute a quorum for the transaction of business.

(D) Tie vote. In the event of a tie vote, the matter upon which such vote is being cast shall fail to pass.
