§ 2.28.010 ESTABLISHED.

There is hereby established, recreated and continued a Parks and Recreation Commission of the city.

§ 2.28.020 COMPOSITION; APPOINTMENT AND TERM OF OFFICE; QUALIFICATIONS.

(A) Composition. The Parks and Recreation Commission shall consist of ten members.

(B) Appointment; term of office. All terms of office of all present members of the Parks and Recreation Commission shall expire at 12:01 a.m. on March 25, 1985. Each Councilman, at the second regular City Council meeting held in March, 1985, shall appoint two members to the Parks and Recreation Commission and shall announce the names of his or her appointees at that meeting.

(1) The term of office for each member of the Parks and Recreation Commission shall terminate annually at 12:01 a.m. on the date of the second regular City Council meeting held in March of each year. Commencing on the date of the second regular City Council meeting held in March, 1986, and annually thereafter, each Councilman shall appoint two members to the Parks and Recreation Commission and shall announce the names of his or her appointees at that meeting.

(2) No person appointed to the Parks and Recreation Commission shall serve more than eight consecutive yearly terms.

(C) Qualifications. All voting members of the Parks and Recreation Commission shall have resided in the city for at least one year next preceding the date of his or her appointment.

§ 2.28.030 EX OFFICIO MEMBERS.

The City Manager, City Attorney and the Director of Parks and Recreation, or their designees, shall be ex officio nonvoting members of the Parks and Recreation Commission.

§ 2.28.040 VACANCIES.

The City Council by unanimous vote may remove for any reason any member of the Parks and Recreation Commission at any time. When a vacancy occurs due to removal, resignation or other cause, such vacancy shall be filled for the unexpired term by an appointment made pursuant to division (B) of § 2.28.020 of this code.

§ 2.28.045 ABSENCE FROM MEETINGS.

The membership of any voting member on the Parks and Recreation Commission shall be terminated if that person fails to call the office of Parks and Recreation and report their absence prior to the regular meeting. The Commissioner shall be terminated if they are absent from three regular meetings of the Commission during his or her one- year term of office. Such vacancy shall be filled for the unexpired term by an appointment pursuant to division (B) of § 2.28.020 of this code.

§ 2.28.050 SELECTION OF OFFICERS.

Within ten days after the reorganized Parks and Recreation Commission is appointed, and annually thereafter between April 1 and April 10, such Commission shall meet and organize by selecting one member to be president and one member to be vice president. At the same time, a secretary, who need not be a member of the Parks and Recreation Commission, shall be selected. A vacancy in any such office may be filled at any time during such year by action of the remaining members of the Parks and Recreation Commission.

§ 2.28.060 RULES AND REGULATIONS; RECORD; QUORUM; TIE VOTE.

(A) Rules and regulations, record. Except as hereinafter provided in division (C), the Parks and Recreation Commission shall make and enforce its own rules and regulations with respect to its meetings and shall keep a record of all of its proceedings and transactions.

(B) Quorum. A majority of the voting members of the Parks and Recreation Commission shall con-stitute a quorum for the transaction of business.

(C) Tie vote. In the event of a tie vote, the matter upon which such vote is being cast shall fail to pass.

§ 2.28.070 ACT AS ADVISORY BOARD.

The Parks and Recreation Commission shall act as consulting and advisory board to the city and shall make recommendations in an advisory capacity as to matters pertaining to recreation, and such other subjects as have to do with the orderly and consistent development of parks and recreation.
