§ 2.24.010 CREATED.

There is hereby created and established a City Planning Commission.

§ 2.24.020 COMPOSITION; APPOINTMENT AND TERM OF OFFICE; QUALIFICATIONS.

(A) Composition. The City Planning Commission shall consist of ten members.

(B) Appointment; term of office. All terms of office of all present members of the City Planning Commission shall expire at 12:01 a.m. on March 25, 1985. Each Councilman, at the second regular City Council meeting held in March, 1985, shall appoint two members to the City Planning Commission and shall announce the names of his or her appointees at that meeting.

(1) The term of office for each member of the City Planning Commission shall terminate annually at 12:01 a.m. on the date of the second regular City Council meeting held in March of each year. Commencing on the date of the second regular City Council meeting held in March, 1986, and annually thereafter, each Councilman shall appoint two members to the City Planning Commission and shall announce the names of his or her appointees at that meeting.

(2) No person appointed to the City Planning Commission shall serve more than eight consecutive yearly terms.

(C) Qualifications. To be eligible to membership on the City Planning Commission, a person must be at least 18 years of age and shall have resided in the city for at least one year next preceding the date of his or her appointment.

§ 2.24.030 EX OFFICIO MEMBERS.

In addition to the ten members specified above in § 2.24.020, the City Manager, City Attorney, Director of Community Development and Director of Public Services/City Engineer or their designees, shall be ex officio non-voting members of the City Planning Commission.

§ 2.24.040 VACANCIES.

The City Council by unanimous vote may remove for any reason any member of the City Planning Commission at any time. When a vacancy occurs due to removal, resignation or other cause, such vacancy shall be filled for the unexpired term by an appointment made pursuant to division (B) of § 2.24.020 of this code.

§ 2.24.045 ABSENCE FROM MEETINGS.

The membership of any voting member on the City Planning Commission shall be terminated if that person is absent without cause from three regular meetings of the Commission during his or her one-year term of office, and such vacancy shall be filled for the unexpired term by an appointment pursuant to division (B) of § 2.24.020 of this code.

§ 2.24.050 SELECTION OF OFFICERS.

Within ten days after the reorganized City Planning Commission is appointed, and annually thereafter between April 1 and April 10, such commission shall meet and organize by selecting one member to be president and one member to be vice president. At the same time, a secretary, who need not be a member of the City Planning Commission, shall be selected. A vacancy in any such office may be filled at any time during such year by action of the remaining members of the City Planning Commis-sion.

§ 2.24.060 RULES AND REGULATIONS; RECORD; QUORUM; TIE VOTE.

(A) Rules and regulations, record. Except as hereinafter provided in division (C), the City Planning Commission shall make and enforce its own rules and regulations with respect to its meetings and shall keep a record of all of its proceedings and transactions.

(B) Quorum. A majority of the voting members of the City Planning Commission shall constitute a quorum for the transaction of business.

(C) Tie vote. In the event of a tie vote, the matter upon which such vote is being cast shall fail to pass.

§ 2.24.070 MEETINGS; COMPENSATION.

Meetings of the City Planning Commission shall be held at least once a month. Members of the City Planning Commission shall serve without compensa-tion: provided, however, that the secretary thereof shall receive such compensation as may be approved by the City Council.

§ 2.24.080 CONSULTING AND ADVISORY BOARD TO CITY COUNCIL.

The City Planning Commission shall act as consulting and advisory board to the City Council with respect to zoning and planning matters and any other matters which may be assigned to it from time to time by the City Council.

§ 2.24.090 PLANS FOR PUBLIC ENTERPRISE; SURVEY WORK FOR CITY PLANNING.

The City Planning Commission may secure plans for public enterprises, originating from private sources, and classify the same for reference. The Commission, either upon its own initiative or by the direction of the City Council, shall also undertake such survey work as will tend to concentrate under the City's Control all information and intelligence on city planning matters that will be of service to the Council and city departments in carrying on the orderly and systematic development of the city.

§ 2.24.100 CITY OFFICERS AND DEPARTMENTS TO COOPERATE.

All officers, departments and department heads of the city shall render cooperation and all reasonable and necessary assistance to the City Planning Commission and its officers and employees.

§ 2.24.110 ANNUAL REPORT TO CITY COUNCIL.

The City Planning Commission shall render annually a full report of its work to the City Council.

§ 2.24.120 ADDITIONAL POWERS GRANTED BY STATE LAW.

Except as heretofore provided by law and except as the City Council may provide herein or hereafter by law, the City Planning Commission shall have the powers set forth in the Cal. Gov't Code §§ 65000 et seq.

§ 2.24.130 ANNUAL OPERATING EXPENSES.

The City Council shall annually in the preparation of the budget for the ensuing fiscal year make proper provision for the necessary expenses of the City Planning Commission in such amount as may be determined each year by the City Council.
