§ 2.23.010 PURPOSE OF CHAPTER.

The declared purpose of this chapter is to provide citizens with an adequate opportunity to participate in an advisory role in planning implementing and assessing the city's Consolidated Strategy and Plan for Housing and Community Development Programs. Such citizen participation shall include, but not be limited to, involvement in developing the citizen participation plan as well as involvement in the following areas:

(A) Application development. Citizens shall be involved in development of the annual application, including:

(1) The three-year Consolidated Strategy and Plan for Housing and Community Development Programs, including the identification of community development and housing needs, and the setting of priorities;

(2) The annual Consolidated Strategy and Plan for Housing and Community Development Programs Update; and

(3) Subsequent amendments and other changes to the above.

(B) Program implementation.

(C) Assessment of performance.

§ 2.23.020 HCDA CITIZEN ADVISORY COMMITTEE CREATED.

In order to carry out the declared purpose of this chapter there is hereby created and established a general community-wide Citizens' Advisory Committee to be known as the HCDA Citizen Advisory Committee. This Committee shall supersede and take the place of the Citizens' Advisory Committee established and created by Resolution No. R74-177 of the City Council.

§ 2.23.030 COMPOSITION AND QUALIFICATIONS.

(A) Composition. The HCDA Citizen Advisory Committee shall consist of five members and shall be composed of low and moderate income persons, members of minority groups-residents of areas where a significant amount of activity is proposed or on-going, the elderly, the handicapped, the business community and members of civic groups who are concerned about the program. There shall be sub- stantial representation on the committee of low and moderate-income citizens and members of minority groups.

(B) Qualifications. To be eligible for member-ship on the HCDA Citizen Advisory Committee, a person must be either a resident of the city or a member of its business community and representative of one or more of the groups of persons set forth in division (A) above.

§ 2.23.040 APPOINTMENT AND TERM OF OFFICE.

(A) All terms of office of all present members of the HCDA Citizen Advisory Committee shall expire at 12:01 a.m. on March 25, 1985. Each Councilman, at the second regular City Council meeting held in March 1985, shall appoint one member to the HCDA citizen advisory committee and shall announce the name of his or her appointee at that meeting.

(B) The term of office for each member of the HCDA Citizen Advisory Committee shall terminate annually at 12:01 a.m., on the date of the second regular City Council meeting held in March of each year. Commencing on the date of the second regular City Council meeting held in March, 1986, and annually thereafter, each Councilman shall appoint one member to the HCDA Citizen Advisory Committee and shall announce the names of his or her appointee at that meeting.

(C) No person appointed to the HCDA Citizen Advisory Committee shall serve more than eight consecutive yearly terms.

§ 2.23.045 VACANCIES.

The City Council by unanimous vote may remove for any reason any member of the HCDA Citizen Advisory Committee at any time. When a vacancy occurs due to removal, resignation or other cause, such vacancy shall be filled for the unexpired term by an appointment made pursuant to § 2.23.040 of this code.

§ 2.23.050 EX OFFICIO MEMBERS.

In addition to the five members of the HCDA Citizen Advisory Committee, the City Manager, City Attorney and the Director of Community Development, or their designees, shall be ex officio nonvoting members of the committee.

§ 2.23.060 ABSENCE FROM MEETINGS.

The membership of any voting member on the HCDA Citizen Advisory Committee shall be terminated if that person is absent without cause from three regular meetings of the committee during his or her one-year term of office, and such vacancy shall be filled for the unexpired term by an appointment made pursuant to § 2.23.040 of this code.

§ 2.23.070 SELECTION OF OFFICERS.

Within ten days after the reorganized HCDA Citizen Advisory Committee is appointed, and annually thereafter between April 1 and April 10, such committee shall meet and organize by selecting one member to be president and one member to be vice president. At the same time, a secretary, who need not be a member of the HCDA Citizen Advisory Committee, shall be selected. A vacancy in any such office may be filled at any time during such year by action of the remaining members of the HCDA Citizen Advisory Committee.

§ 2.23.080 RULES AND REGULATIONS; RECORD; QUORUM; TIE VOTE.

(A) Rules and regulations, record. Except as hereinafter provided in division (C), the HCDA Citizen Advisory Committee shall make and enforce its own rules and regulations with respect to its meetings and shall keep a record of all of its proceedings and transactions.

(B) Quorum. A majority of the voting members of the HCDA Citizen Advisory Committee shall constitute a quorum for the transaction of business.

(C) Tie Vote. In the event of a tie vote, the matter upon which such vote is being cast shall fail to pass.

§ 2.23.090 MEETINGS; COMPENSATION.

(A) Meetings of the HCDA Citizen Advisory Committee shall be held not less often than once during each three-month period at such times as may be selected by the Committee.

(B) Members of the HCDA Citizen Advisory Committee shall serve without compensation, provided, however, that the secretary thereof shall receive such compensation as may be approved by the City Council.

§ 2.23.100 ADVISORY BOARD TO COUNCIL.

The HCDA Citizen Advisory Committee shall act as an advisory board to the City Council and shall, either upon its own initiative or upon the specific request of the City Council, make investiga-tions and recommendations directly to the City Council in an advisory capacity as to those matters pertaining to the city's Consolidated Strategy and Plan for Housing and Community Development Programs.

§ 2.23.110 CITY OFFICERS AND DEPARTMENTS TO COOPERATE.

All officers, departments and department heads of the city shall cooperate with and furnish all reasonable and necessary assistance to the HCDA Citizen Advisory Committee.

§ 2.23.120 ANNUAL OPERATING EXPENSES.

The City Council shall annually in the prepara-tion of the budget for the ensuing fiscal year make provision for the payment of the necessary expenses of the HCDA Citizen Advisory Committee.

§ 2.23.130 ANNUAL REPORT TO COUNCIL.

The HCDA Citizen Advisory Committee shall render annually a full report of its work to the City Council.
