4-25.1 - Purpose.

The City Council finds and declares that the parking of vehicles in front and side yards of residentially zoned property between the public right of way and any building or structure constitutes visual blight and depreciates neighborhood property values. The City Council finds it in the interest of the public health, safety and welfare to prohibit the parking of vehicles in front and side yards in residentially zoned districts.

4-25.2 - Prohibitions; Exceptions.

a. It shall be unlawful for any person to park or store a vehicle in a residentially zoned area in the front yard, side yard or any additional area between the right-of-way and any residence or accessory building or structure located therein.

b. It shall be unlawful for the owner, lessee, tenant, occupier or person in possession of any lot or parcel situated in a residentially zoned area to park a vehicle in the front yard, side yard or any additional area between the right-of-way and any residence or accessory building or structure located therein or permit, consent, suffer or allow any other person to so park a vehicle.

c. Notwithstanding the foregoing:

  1. Vehicles may be parked in driveways or other designated parking space.

  2. "Driveway" shall mean any paved or prepared vehicle passage which connects one or more lawfully established parking spaces to a public or private thoroughfare by means of a curb cut.

  3. "Designated parking space" shall mean any parking space which has been lawfully established.

  4. Parking of vehicles is permitted in any setback or on any surface which has been previously approved for parking purposes pursuant to applicable Building and/or Zoning Code provisions.

4-25.3 - Authority to Issue Citation.

The Code Enforcement Officer or other person authorized and designated by the Chief of Police to enforce this code is authorized to issue a citation for a violation of this section.

4-25.4 - Violation is an Infraction.

Any person convicted of violating any of the provisions of this section shall be deemed guilty of an infraction and shall be punishable as set forth in subsection 1-5.1(e) of this Code.
