Chapter 6.20 — BURIALS AND CREMATIONS

6.20.010 - Burial in St. Joseph's Cemetery—Prohibited—Penalty.¶
Every person who buries, deposits, or inters, or causes or permits to be buried, deposited or interred, any dead body of a human being in that certain graveyard and cemetery immediately adjoining St. Joseph's Catholic Church, situated in the unincorporated town of Mission San Jose, county of Alameda, is guilty of a misdemeanor. Upon conviction he shall be punished by a fine not to exceed one hundred dollars ($100.00); and if the fine is not paid, then by imprisonment in the county jail at the rate of one day for every two dollars ($2.00) of the fine.

6.20.020 - Exceptions.¶
Any lot or plot in St. Joseph's graveyard or cemetery which was acquired for burial purposes before the adoption of the ordinance codified in this section, and which is now marked and designated so that it may be identified, may be used for burial purposes by the person or persons owning or otherwise entitled to use the lot for burial purposes.

6.20.030 - Crematoriums, unlawful to erect etc., within three hundred feet of residences.¶
It is unlawful for any person, firm, association or corporation to erect, maintain, or operate any buildings, furnace or other appliances for cremating, incinerating, burning or other destroying of human bodies or any parts thereof, within three hundred (300) feet from any established residence in the county unless the use is approved by the planning commission under Section 17.52.035(B) of this code.
This section shall not prevent the erection, operating or maintaining of any buildings, furnaces, or other appliances for cremating, incinerating, burning or other destroying of human bodies or other parts thereof as to any residence or residences, erected or established within the prescribed limits subsequently to the time of posting on the premises to be used and occupied for the buildings, furnaces or other appliances, a notice of intention to erect, operate and maintain the buildings, furnaces or other appliances on the posted premises.

6.20.040 - Violation—Penalty.¶
Each day's violation of Section 6.20.030 is a separate offense.
Every person who violates Section 6.20.030 is guilty of a misdemeanor and upon conviction shall be punished for each offense by a fine not exceeding five hundred dollars ($500.00), or by imprisonment in the county jail not exceeding six months, or by both.
